Amending O. Reg. 347/07

(Provincial Parks: General Provisions)

1. (1) The definition of “non-resident” in subsection 1 (1) of Ontario Regulation 347/07 is amended by striking out “not resident in Canada” at the end and substituting “not a resident of Canada”.

(2) Subsection 1 (2) of the Regulation is revoked and the following substituted:

(2) Subsections 8 (3), 10 (3), 14 (1) and (2), section 15, subsections 16 (1), 17 (1) and (5) and 22 (1) and sections 23 and 32 do not apply with respect to non-operating parks.

2. (1) Subsection 4 (4) of the Regulation is amended by striking out “and” at the end of clause (a) and substituting “or”.

(2) Section 4 of the Regulation is amended by adding the following subsections:

(5) No person shall possess any non-burnable food or beverage containers in any part of Kawartha Highlands Signature Site Park other than containers,

(a) that are specifically designed and intended for repeated use and for which no deposit is charged; or

(b) that are specifically designed for dehydrated food.

(6) Subsections (4) and (5) do not apply to a person,

(a) if the person is on, or travelling directly to or from, land situated in a park mentioned in subsection (4) or (5) that is occupied under a lease, licence of occupation, land use permit or agreement; or

(b) if the person is travelling directly to or from land that is held in fee simple that abuts or is surrounded by a park mentioned in subsection (4) or (5).

(7) No person shall possess any glass bottles in Woodland Caribou Provincial Park, except while on, or travelling directly to or from, land situated in the park that is occupied

under a lease, licence of occupation, land use permit or agreement.

3. Subsection 5 (1) of the Regulation is amended by striking out “except in a fireplace” and substituting “except in a fireplace provided by the superintendent”.

4. Subsection 14 (3) of the Regulation is amended by striking out “by the superintendent” and substituting “by an officer”.

5. Subsection 17 (4) of the Regulation is revoked and the following substituted:

(4) Despite subsections (2) and (3), the maximum number of persons that may occupy an interior camp-site in Frontenac Provincial Park is six, unless the party consists of a single family of parents and their children.

6. Subsection 18 (1) of the Regulation is amended by striking out “of Canada” in the portion before clause (a).

7. (1) Subsection 19 (1) of the Regulation is amended by striking out “campground camp-site, interior camp-site or unserviced camp-site” and substituting “campground camp-site or unserviced camp-site”.

(2) Subsection 19 (2) of the Regulation is amended by striking out “house trailer” and substituting “travel trailer”.

8. Section 20 of the Regulation is revoked and the following substituted:

Algonquin and Kawartha Highlands, special case

20. Between December 1 and March 31, no person shall camp within 30 metres of the nearest portage or shoreline,

(a) in an area operated for interior camping in Algonquin Provincial Park; or

(b) in Kawartha Highlands Signature Site Park.

9. Section 21 of the Regulation is amended by adding the following subsections:

(3) No person shall at any time use a chain saw or similar device in Kawartha Highlands Signature Site Park except,

(a) for emergency purposes;

(b) for the removal of safety hazards; or

(c) with the authorization of the superintendent.

(4) No person shall at any time possess a gasoline generator or similar device in Kawartha Highlands Signature Site Park, except with the authorization of the superintendent.

10. Subsection 22 (2) of the Regulation is amended by striking out “in a campground or camp-site” and substituting “on a campground camp-site”.

11. Section 28 of the Regulation is amended by striking out “Algonquin or Sandbanks Provincial Park” and substituting “Algonquin Provincial Park”.

12. Section 31 of the Regulation is amended by adding the following subsection:

(3) No person shall moor a power boat overnight in Kawartha Highlands Signature Site Park, unless the power boat is moored in the reasonable exercise of the right of navigation.

13. Subsection 33 (3) of the Regulation is revoked.

14. (1) Item 4 of Schedule 1 to the Regulation is amended by striking out “All except” in Column 3 and substituting “All waters, except”.

(2) Item 30 of Schedule 1 to the Regulation is amended by striking out “All except the most southerly 12 kilometers” in Column 3 and substituting “All waters, except the most southerly 12 kilometres”.

(3) Item 39 of Schedule 1 to the Regulation is revoked and the following substituted:

Kawartha Highlands Signature Site Park


All lakes identified as those on which motorboats are permitted in Figure 5: Motorboat Use, in the Kawartha Highlands Signature Site Park Management Plan, dated October 2008 and available for public inspection at the Ministry of Natural Resources Bancroft District Office or electronically on the Ontario Parks website .



(4) Item 51 of Schedule 1 to the Regulation is amended by striking out “All waters” in Column 3 and substituting “Alexander Lake only”.

(5) Item 61 of Schedule 1 to the Regulation is amended by striking out “All waters” in Column 3 and substituting “All waters, except Wakimika Lake, Wakimika River Wilderness Zone - W2 and Obabika River - NE4”.

15. This Regulation comes into force on the later of January 1, 2011 and the day it is filed.
