EXEMPTIONS REGULATIONS

The Commissioner, on the recommendation of the Minister, under section 11 of the Exemptions Act and every enabling power, makes the annexed Exemptions Regulations. 1. The prescribed amount referred to paragraph 2(1)(f) of the Act is $35,000. 2. (1) In this section, a debtor's net pay is determined by deducting the following from the wages or salary payable to the debtor:

(a) income tax paid by the debtor; (b) Canada Pension Plan contributions paid by the debtor; (c) Employment Insurance contributions paid by the debtor.

(2) The amount of wages and salary exempt from attachment by garnishment under

paragraph 9(1)(a) of the Act is the higher of (a) $1,500, plus an additional $300 per month per dependant; or (b) 70% of the debtor's net pay per month to a maximum of $3,500 per month,

plus an additional $300 per month per dependant. 3. These regulations come into force on the later of June 1, 2006, and the day these regulations are registered with the Registrar of Regulations.
