1.       Citation

            This Order may be cited as the Orapa and Letlhakane Mine Waterworks Areas Declaration Order.

2.       Interpretation

            In this Order-

            "Letlhakane mine" means the Letlhakane Mine as is defined hereinafter in Schedule II;

            "Orapa" means the Orapa area as is defined hereinafter in Schedule I.

3.       Declaration of Orapa and Letlhakane Mine Waterworks Areas

            Orapa and Letlhakane Mine are hereby declared to be Waterworks Areas to be known as Orapa Waterworks Area and Letlhakane Mine Waterworks Area for the purposes of the Act.

SCHEDULE I
ORAPA WATERWORKS AREA

Commencing at a point A the co-ordinates of which are Y-31344.511 and X+234 7880.877 the boundary runs in a straight line in an easterly direction to a point D the co-ordinates of which are Y-44219.240 and X+2347880.877;thence in a straight line in a southerly direction to a point G the co-ordinates of which are Y-44219.240 and X+2360755.607; thence in a straight line in a westerly direction to a point K the co-ordinates of which are Y-31344.511 X+2360755.607; thence in a northerly direction to the point of commencement, as will more fully appear from Plan DSL 10/70 filed in the Department of Surveys and Lands, the co-ordinates of points A,D, G and K being expressed in metres on the Trigonometrical system Lo 25°.

SCHEDULE II
LETLHAKANE MINE WATERWORKS AREA

Commencing at a point A the co-ordinates of which are Y-70300.15 and X+2379420.04 the boundary runs in a straight line in an easterly direction to a point B the co-ordinates of which are Y-72899.86 and X+2379419.93; thence in a straight line in a southerly direction to a point C the co-ordinates of which are Y-72900.47 and X+2382219.89; thence in a straight line in a westerly direction to a point D the co-ordinates of which are Y-70 300.20 and X+2382220.13; thence in a northerly direction to the point of commencement, as will more fully appear from Plan No. 5, filed in the Department of Surveys and Lands, the co-ordinates of points A,B, C and D being expressed in metres on the Trigonometrical system Lo 25°.

1.       Citation

            This Order may be cited as the Declaration of Waterworks Area Order.

2.       Declaration of waterworks areas

            (1) Each city or township referred to in the First Schedule to this Order, being an area in which an undertaking exists, is declared to be a waterworks area, the boundaries of which are defined in the Townships Act.

            (2) Each village or area referred to in the Second Schedule to this Order, being an area in which an undertaking exists is declared to be a waterworks area, the boundaries of which are set out in the Third Schedule.

     Commencing at point "A" (approximate co-ordinates Y=-26 500, X=1968100) being a point on the right bank of the Chobe river; thence southwards to point "B" (approximate co-ordinates Y=-26 500, X= 1970500); thence westwards to point "C" (approximate co-ordinates Y=-24 000, X=1970500); thence northwards to point "D" (approximate co-ordinates Y=-24000, X=1969000); thence westwards to point "E" (approximate co-ordinates Y=-18000, X=1969000; thence southwards to point "F" (approximates co-ordinates Y=-18 000; X=1970500); thence westwards to point "G" (approximate co-ordinates Y=-14850, X=1970500) being a point on the right bank of a minor channel of the Chobe river; thence upstream along the right bank of the said minor channel until it reaches the main channel of the Chobe river to point "A" of commencement as will more fully appear on Plan RO - 39a lodged with the Department of Surveys and Lands.

     Co-ordinates are in metres on trigonometric system based on longitude 25 degrees.

3. LETLHAKANE S.I. 25/1990.

     Commencing at a point "A" on the north side of the old Orapa road with coordinates of Y=-59 500 m X=+2 371 900 m; the boundary runs in a general northwesterly direction along the said north side of the old Orapa road for a distance of 700 m to point "B" having approximate coordinates of Y=-58 940 m X=-2 372350 m; it further runs in a general northeasterly direction for a distance of 1800 m to a point "C" having approximate coordinates Y=-59 500 m X=+2 374 000 m; then in an easterly direction for a distance of 1 200 m to a point "D" having approximate coordinates Y=-60 700 m X=+2 374 000 m; then in a southeasterly direction for a distance of 2 950 m to a point "E" having approximate coordinates of Y=-62 650 m X=+2 371 800 m; then also in a southeasterly direction for a distance of 2 650 to a point "F" having approximate coordinates of Y=-63 280 m X=+2 369 200 m; then in a southwesterly direction for 650 m to a point "G" with approximate coordinates Y=-62 940 m X=+2 368 650 m; then in a westerly direction for a distance of 750 m to a point "H" with approximate coordinates Y=-62 200 m X=+2 368 540 m; then in a northwesterly direction for a distance of 3360 m to a point "J" with approximate coordinates Y=-59 500 m X=+2 370 500 m; then due north for a distance of 1 400 m to the point of commencement at point "A".

     Commencing at point A (approximate coordinates Y + 19600m, X + 2551 100m) being a point due west of the bridge across the Mahalapye River at Tapalamanong along the old Francistown to Gaborone road; thence south eastwards to point "B" (approximate coordinates Y + 13200, + X + 2553400); thence southwards to point "C" (approximate coordinates Y + 13100, X + 2561300); thence westwards to point "D" (approximate coordinates Y + 18900, X + 2561100); thence northwards to point "E" (approximate coordinates Y + 21300, X + 2558100); thence due north to point "F" (approximate coordinates Y + 21300, X + 2553200), thence north eastwards to point "A" of commencement as will more fully appear on plan LP - 19a lodged with the Department of Surveys and Lands.

     Coordinates are in metres on trigonometric system based on longitude 27°.

5. MAUN S.I. 3/2001.

     Commencing at a point "A" (co-ordinates Y - 87300 X + 2723200) the boundary runs in an east-northeasterly direction to a point "B" (co-ordinates Y - 88300 X + 2722800) thence in an east-southeasterly direction to a point "C" (co-ordinates Y - 90200, X + 2723189,67) being a point on the boundary between Bakwena Tribal Block and Gaborone Block, thence in a southwesterly direction along that boundary to a point "D" (co-ordinates Y - 87300 X + 2726898,78) being another point on the boundary between Bakwena Tribal Block and Gaborone Block, thence in a northwesterly direction to a point "E" (co-ordinates Y - 86200 X + 2725800), thence northwards to a point "F" (co-ordinates Y - 86200 X + 2723800), thence in a northeasterly direction to a point "G" (co-ordinates Y - 87000 X + 2722800), thence in a southeasterly direction to the point of commencement.      Co-ordinates are in metres on Trigonometric system based on Lo 27°.

11. RAMOTSWA

     Commencing at a point "A" the co-ordinates of which are Y = - 86830, X = + 2750400 the boundary runs due east to a point "B" on the median line of the Notwane River being the international boundary between Botswana and the Republic of South Africa, thence along the said international boundary to a point "C" of which the X co-ordinate is + 2754000; thence due westwards to a point "D" the co-ordinates of which are Y = - 87500, X = + 275400; thence north-westwards to a point "E" the co-ordinates of which are Y = - 87000, X = + 27535000; thence northwards to a point "F" the co-ordinates of which are Y = - 87000, X = + 2752000; thence north-westwards to point "G" the co-ordinates of which are Y = - 86500, X = + 2751500; thence in a northerly direction to a point "H" the co-ordinates of which are Y = - 86550, X = + 2751000; thence in a north-easterly direction to "A" the point of commencement as will more fully appear from Plan No. KO-232 deposited in the Department of Surveys and Lands, Gaborone.             (2) The boundaries of the area referred to in subparagraph (1) shall be the boundaries of Sowa Township as defined in the Declaration of Sowa Township Order, 1990 (Statutory Instrument 32 of 1990).

            The use of potable water for filling or topping up swimming pools, and of washing motor vehicles by hosepipe and watering gardens by hosepipe by consumers supplied by the Lobatse Water Undertaking within the Lobatse Waterworks Area is hereby prohibited from the 19th November, 1990, until further notice.

3.       Offence

            Any person who contravenes paragraph 2 of this Order shall be guilty of an offence and shall be liable to the penalties provided under section 26 of the Act.

MAUN WATERWORKS AREAS ORDER

(under section 17)

1.       Citation

            This Order may be cited as the Maun Waterworks Areas Order.

2.       Prohibition of use of water for specific purposes

            (a) The following activities are with immediate effect prohibited-

      (i)     new private connections;

      (ii)     washing of vehicles by hose pipe;

     (iii)     any form of irrigation or watering of gardens, lawns etc.

     (iv)     use of water for major construction activities.

            (b) These measures will remain in force until further notice.

            (c) The public is reminded that under all circumstances the following are prohibited-

      (i)     collection and cartage of water in drums from public standpipes and private connections;

      (ii)     watering of livestock from standpipes and private connections.

3.       Offences and penalties

            Any person who contravenes paragraphs 2(a) and 2(c) of this Order shall be guilty of an offence and shall be liable to the penalties provided under section 26 of the Act.

FRANCISTOWN WATERWORKS (PRESCRIBED CHARGES) ORDER [i]*

1.       Citation

            This Order may be cited as the Francistown Waterworks (Prescribed Charges) Order.

2.       Charges

            The charges to be paid within the Francistown Township shall be as follows-

     (a)     the charge to be paid by any consumer per unit of quantity of water supplied through a meter installed to serve the consumer's premises shall be 40t per 1000 gallons;

     (b)     the minimum charge to be paid by any consumer for water so supplied shall be P2 per month or part of a month during which the premises of such consumer remain connected to the main water supply;

     (c)     the rent to be paid for a water meter installed by the Francistown Town Council shall be P20 and shall cover the whole of the period during which such meter remains so installed:

                      Provided that where the cost of installing a meter is greater than P20 the rent to be paid in respect of such meter shall be equal to the cost of such installation;

     (d)     the charges incurred by any consumer under the provisions of paragraphs (a) and (b) shall be paid by a consumer within 15 days of the rendering by the Francistown Town Council of an account therefor. The rental to be paid in terms of paragraph (c) in respect of any meter to be installed shall be paid on the approval of the fittings and pipes leading from the consumer's premises to the point of connection with the meter.

            All consumers receiving a supply of water shall pay a deposit as follows-

          Premises used mainly for domestic purposes, or subject to the exceptions listed below, as business or trading premises
