            (1) Regulations may be made in respect of any matter within the purview of this Act, which need not be in conformity with the other provisions of this Act in relation to employees belonging to any category or description of employees for which it is considered that special provision ought, in the interests of Botswana, to be made:

            Provided that before making such regulations, the Labour Advisory Board shall be consulted.

            (2) Regulations made under this section may provide, in respect of any contravention of the regulations, that the offender shall be liable to a fine not exceeding P2 000 or to imprisonment for a term not exceeding 18 months, or to both:

            Provided that the Minister shall, before fixing the penalty with reference to any particular contravention, have regard to the scale of penalties prescribed by section 151.
