Act 31, 1979.
An Act to regulate proceedings instituted by or against local authorities.
[Date of Commencement: 19th September, 1979]
1. Short title
This Act may be cited as the Local Authority (Proceedings) Act.
2. Interpretation
In this Act "local authority" includes a land board established under the Tribal Land Act.
3. Action against local authority
No action shall be brought against a local authority unless at least 30 days' written notice of an intention to bring such action has been served on the local authority.
4. Limitation of action against local authority
No action shall be brought against a local authority after the expiration of two years from the date on which the cause of action accrued.
5. Prosecution and defence of actions by Attorney-General on behalf of local authority
Where an action is brought by or against a local authority the Attorney-General may, if in his opinion such action is likely to have effect on a major government policy, prosecute or defend, as the case may be, such action on behalf of the local authority.
