Act 1, 1977.

An Act to prescribe the retiring age of certain judges of the High Court for the purposes of section 97(1) of the Constitution.

[Date of Commencement: 7th January, 1977]

 

1.       Short title

 

            This Act may be cited as the Judges (Retiring Age) Act.

 

2.       Retiring age of judges other than those on pensionable terms

 

            For the purposes of section 97(1) of the Constitution, if the President, acting in accordance with the advice of the Judicial Service Commission, considers it to be in the public interest, a person may be appointed to the office of judge of the High Court, and shall not be required to vacate that office, notwithstanding the fact that he may have attained the age of 62 years:

            Provided that-

      (i)     such appointment shall be on terms which are not pensionable by any law;

      (ii)     no such appointment shall be made in respect of any person who has attained the age of 70 years.
