An Act to define the boundaries of Botswana.

[Date of Commencement: 27th September, 1892]

 

1.       Short title

 

            This Act may be cited as the Botswana Boundaries Act.

 

2.       Limits of Botswana

 

            The jurisdiction of the Republic of Botswana shall be exercised throughout the following Territories and districts:

     (a)     The Territories lying between the Crown Colony of British Bechuanaland [Republic of South Africa], the 22nd parallel of the South Latitude and Matloutse River.

     (b)     The Territory known as the disputed Territory lying between the Shashe and Macloutsie Rivers, excepting the area included in the Tuli District.

     (c)     The Tati District.

     (d)     Such Territories north of the 22nd parallel of South Latitude as belong to the Chief Khama of the Bamangwato.

     (e)     Such Territories lying to the north and the west of the Territories of the Chief Khama as do not belong to the Chief Lobengula.

 

3.       Defining Eastern Boundary

 

            The Territory of Botswana consisting of the Territories and districts described in section 2, shall, from and after the commencement of this Act, be bounded on the East as follows:

            By the Transvaal Province of the Republic of South Africa from Ramathlabama Spruit to a point opposite the mouth of the River Shashe, thence by the River Shashe to its junction with the Ramokgwebana River, thence by the Ramokgwebana River to its source, thence by the watershed of the River Shashe and Ramokgwebana until such watershed strikes the Hunter's Road (called the Pandamatenga Road), thence by that road to the River Zambesi; and section 2 is to be read subject to the description of the boundaries herein set out, and after the date hereof the area herein defined shall constitute the limits of Botswana, an area of 16 kilometres radius round Fort Tuli being, as heretofore, excluded from the area of Botswana.

 

4.       Ikaneng and Montshioa's Territories withdrawn from administration of B.S.A. Company

 

            From and after the commencement of the Act the territories of the Chiefs Ikaneng and Montshioa as described in Schedules A and B shall be withdrawn from the administration of the British South Africa Company, and shall be replaced under the direct administration of Her Majesty's High Commissioner as portions of the Bechuanaland Protectorate, and shall be and remain subject to all the laws now or hereafter in force in the said Protectorate.

 

SCHEDULE A
BOUNDARIES OF THE BAMALETE TERRITORY

 

     Bounded on the east by the Transvaal Province, on the north by the Territory of the Chief Sebele of the Bakwena, on the south and west by the Territory of the Chief Bathoen of the Bangwaketse.

 

SCHEDULE B
BOUNDARIES OF THE BAROLONG FARMS

 

     Bounded on the east by the Transvaal Province to a place called Maiphetlane, thence on the north by Mahura's Pan, thence to the top of the hill Ngwabati, otherwise known as Korwe, thence to a point about a mile north-west of the Mogwalale Pans, and from thence on the west by a line direct to the junction of the Paring Spruit and the Molopo River on the south by the Molopo River and the Ramathlabama Spruit.
