WHEREAS it is expedient to amend the Bermuda Hospitals Board Act 1970, to
make consequential amendments to the Health Insurance (Standard Hospital Benefit)
Regulations 1971, and to allow regulations prescribing hospital fees to include fees that are
not in respect of standard hospital benefit;

Be it enacted by The Queen’s Most Excellent Majesty, by and with the advice and
consent of the Senate and the House of Assembly of Bermuda, and by the authority of the
same, as follows:

Citation
This Act may be cited as the Bermuda Hospitals Board Amendment Act 2012.

Amends section 13 of the Bermuda Hospitals Board Act 1970
Section 13(1) of the Bermuda Hospitals Board Act 1970 is amended by, immediately

after “fees” inserting “, and specify which of these fees, if any, are in respect of treatment
that is excluded from standard hospital benefit”.

Amends Health Insurance (Standard Hospital Benefit) Regulations 1971
The Health Insurance (Standard Hospital Benefit) Regulations 1971 are

amended—

in regulation 5 by, immediately after paragraph (x), inserting the
following—

treatment that is excluded from standard hospital benefit by
regulations made under section 13 of the Bermuda Hospitals
Board Act 1970;”; and

“(xa)

in regulation 6 by, immediately after “shall include”, inserting “, subject to
any exclusions specified pursuant to section 13(1) of the Bermuda
Hospitals Board Act 1970,”.

Authorizes Bermuda Hospitals Board (Hospital Fees) Regulations 2012 to be made
On the coming into operation of this Act, the Bermuda Hospitals Board (Hospital

Fees) Regulations 2012 (set out in the Schedule to this Act) shall—

notwithstanding section 13(2) of the Bermuda Hospitals Board Act 1970,
be deemed to be authorized by the affirmative resolution procedure to be
made;

be authorized to come into operation on 1 April 2012.

Commencement
This Act comes into operation on 1 April 2012.
