GOVERNMENT FEES AMENDMENT REGULATIONS 2010

BR 13 / 2010

The Minister of Finance, in exercise of the powers conferred by section 2(1) of the
Government Fees Act 1965, makes the following Regulations:

Citation
These Regulations may be cited as the Government Fees Amendment Regulations

2010.

Revokes and replaces Schedule
The Schedule to the Government Fees Regulations 1976 is revoked and replaced

by the contents of the Schedule to these Regulations.

Commencement and transitional
Subject to paragraph (2), these Regulations come into operation on 1 April

2010.

Nothing in these Regulations affects the validity of a fee that is paid before the
coming into operation of these Regulations.

Bermudian status who is under 18 years of age and resides with him,
or a person who either was born in Bermuda or first arrived in
Bermuda before his sixth birthday and can potentially qualify for the
grant of Bermudian status under section 20A—

(a) under a work permit valid for such period as may be specified
in the permit (fee is non-refundable) $85

(b) under a letter of permission (where-under the Minister may
grant such permission for a period of time specified in the letter
not exceeding 5 years to not-for-profit organisations, including
registered charitable organisations, for the employment of
coaches, teachers of sports and recreation, clergy, speakers and

(8) Where a permission is granted for a period less than that applied for,
the relevant proportion of the fee paid in accordance with categories
(vii) to (xii) of paragraph (6)(a), shall be refunded. Where no permission
of any kind is granted, or where permission is granted and the person
in respect of whom permission is granted does not take up
employment, then the fee paid under categories (iii) to (v) and (vii) to
(xii) of paragraph (6)(a), less $132, shall be refunded.

(9) Where permission is granted in accordance with categories (viii) to (xi)
of paragraph (6)(a) and the work permit is cancelled before the expiry
date, there shall be refunded the relevant fee for each whole year that
remains unused on the date of cancellation.

(10) Considering an application by a restricted person or a trustee for the
benefit of a restricted person for a licence to hold or acquire land $1,375

(Where a licence is granted under paragraph (11), the fee specified in
this paragraph shall be refunded to the applicant.)

(11) Registering the acquisition of land by a restricted person under Part
VI $158

(3) On revising approved plans—

(6) In all cases where the building operations commence prior to the
issue of the required permits listed above, an additional fee will be

(8) Under this item—

For the purposes of calculating the building permit fee in accordance
with paragraphs (1)(a)(i) and (2)(a)(i), the floor space to which the fee
shall apply means the total gross square footage of new construction,
including verandas and balconies, but excluding water tanks,
outdoor paved areas, patios and the like;

“accessory structures” include, but are not limited to, tennis courts,
parking areas, driveways, docks, walls, satellite dish receivers, signs,
piers, platforms, patios and like structures which do not result in the
creation of additional, enclosed floor space, that are incidental to the
principal building and located on the same lot; and, for the avoidance
of doubt, a swimming pool is not an accessory structure and any
separate application for a pool shall be subject to the minimum fee
set out in either paragraph (1)(a)(i) or (2)(a)(i), whichever is applicable;

“re-inspection of works” means a re-inspection made because, at a
previous scheduled visit to the works, either—

(a) conditions at the works prevented proper access to the works;
or

(b) the works did not meet the requirements of the Bermuda
Building Code Regulations 1998; or

(c) the works for some other reason were not available or ready for
inspection; or

(d) a copy of the approved drawings was not available on-site.

In the case of an existing building where the application relates to
building works designed specifically to provide access for, or
otherwise meet the needs of, the physically handicapped, no fee shall
be charged.

In the case of alterations or extensions to a building listed as a
building of special architectural or historical interest in accordance
with section 30 of the Development and Planning Act 1974, no fee
shall be charged.

Head 11
Building Authority Act 1962

(1) Issuing a permit or licence under the Building Authority (Petroleum)
Regulations 1962—

(a) to possess, offer for sale, or store in excess of 10 gallons (45
litres), or to use a portable tank for the transportation of,
dangerous petroleum $361

(b) to maintain or operate an installation for bulk storage of
petroleum gases $773

(c) to possess and offer for sale ordinary petroleum in excess of
275 gallons (1,250 litres) save that no further fee shall be
required from the holder of a subsisting permit or licence
issued under sub-paragraph (a) $155

(2) In respect of the Building Authority (Elevators and Lifts) Regulations
