CUSTOMS DUTY (CABLE CO. LTD.) REMISSION ORDER 2009



The Minister of Finance, in exercise of the powers conferred by

section 2 of the Customs Duty (Special Remission) Act 1951, makes the

following Order:

Citation

1 This Order may be cited as the Customs Duty (Cable Co. Ltd.)

Remission Order 2009.

Interpretation

2 In this Order—

"the Company" means the company incorporated in Bermuda

under the Companies Act 1981 on 15 November 2006 under

the name Key Ltd. and now known as Cable Co. Ltd. by virtue

of the issuance of a certificate of incorporation on change of

name by the Registrar of Companies on 6 February 2007;

"exempted goods" means any telecommunication cable,

equipment, apparatus or machinery imported by the

Company or its agents free of import duty by virtue of

paragraph 3.

Exemption from import duty

3 The Company and its agents are exempted from the payment of

import duty in respect of the importation into Bermuda by them of any

telecommunication cable, equipment, apparatus and machinery—

(a) which are for use directly and solely in the building,

renewal, provision, operation, repair, maintenance or

extension of the Company’s telecommunications network

infrastructure; and

(b) which are for installation on premises owned, leased or

otherwise occupied by the Company.

Expiration

4 This Order shall cease to have effect on 31 March 2013, but in

respect of exempted goods which have been imported free of import duty

into Bermuda by virtue of paragraph 3, import duty does not fall to be

paid by reason only that this Order has ceased to have effect.

Commencement

5 This Order shall be deemed to have come into operation on 1

April 2008.
