PUBLIC HEALTH AMENDMENT ACT 1999

WHEREAS it is expedient to amend the Public Health Act 1949:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation
1 This Act, which amends the Public Health Act 1949 (hereinafter
referred to as "the principal Act"), may be cited as the Public Health
Amendment Act 1999.

Amends section 103 of principal Act
2 Section 103 of the principal Act is amended in subsection (1)(b)
by inserting next after the words "nursing home," the words "diagnostic
facility,".

Amends section 161 of principal Act
3 Section 161 of the principal Act is amended by inserting in the
appropriate alphabetical order the following definitions—

" "diagnostic facility" means a facility that provides one or more
diagnostic services;

"diagnostic services" includes but is not limited to clinical
laboratory services, diagnostic radiology, ultrasound services
and mammography services;".

Amends section 162 of principal Act
4 Section 162 of the principal Act is amended—

(a) in the heading to the section, by inserting next after the
words "nursing home" the words "and diagnostic
facility"; and

(b) by inserting next after subsection (1) the following—

" (1A) No person shall operate a diagnostic facility
unless that facility is registered under this Part.".

Amends section 163 of principal Act
5 Section 163 of the principal Act is amended—

(a) in the heading to the section, by inserting next after the
words "nursing homes" the words "and diagnostic
facilities";

(b) by deleting subsection (1) and substituting the
following—

" (1) The Chief Medical Officer shall cause to be
kept and maintained—

(a) a register of nursing homes; and

(b) a register of diagnostic facilities,

in such form as he may from time to time determine.";

(c) in subsection (2)(a)—

(i) by inserting next after the words "nursing
homes" the words "and diagnostic facilities";

(ii) in subparagraph (i), by inserting next after the
words "nursing home" the words "or diagnostic
facility";

(iii) in subparagraph (ii), by deleting the word
"staffing" and by inserting next after the words
"nursing home" the words "or a diagnostic
facility"; and

(iv) by inserting the following as subparagraph (iii)—

" "(iii) the qualification which must be attained
by specified members of staff prior to
being assigned to specified duties;";

(d) in paragraph (e), by inserting next after the words
"nursing homes" the words "or operating diagnostic
facilities", and by deleting the full stop at the end of that
paragraph and substituting a semi-colon;

(e) by inserting next after paragraph (e) the following—

"(f) for prescribing such other matters in relation to
the carrying on of a nursing home or the
operating of a diagnostic facility as the Minister,
after consultation with the person carrying on
the nursing home or operating the diagnostic
facility, or both, considers appropriate."; and

(f) in subsections (3) and (4), by inserting next after the
words "nursing home" wherever they appear the words
"or diagnostic facility".

Amends section 164 of the principal Act
6 Section 164 of the principal Act is amended—

(a) in the heading to the section, by inserting next after the
words "nursing homes" the words "and diagnostic
facilities".

(b) by deleting the words "Government Medical Officer" and
substituting the words "Public Health Officer, duly
authorized by the Minister for the purpose,"; and

(c) by inserting next after the words "nursing home"
wherever they appear the words "or a diagnostic facility".
