FISHERIES AMENDMENT REGULATIONS (NO. 2) 1998

The Minister in exercise of the power conferred on him by section
13 of the Fisheries Act 1972 makes the following Regulations:

Citation
1 These Regulations which amend the Fisheries Regulations 1972
("the principal Regulations") may be cited as the Fisheries Amendment
Regulations (No. 2) 1998.

Amendment of regulation 4A
2 Regulation 4A of the principal Regulations is amended—

(a) in paragraph (1)(b), by deleting the words "controlling
the fishing industry" and substituting the words
"exploiting certain marine resources specified in the
licence";

(b) by inserting after paragraph (1) the following:

" (1A) The Minister may impose such conditions
as he thinks fit on a licence issued under paragraph (1)
and the conditions shall be specified in the licence".

Amendment of regulation 18
3 Regulation 18 of the principal Regulations is amended—

(a) in the heading, by deleting the word "50" and
substituting the word "15";

(b) in paragraph (2)(e) by deleting the word "five" and
substituting the word "fifteen".

Amendment of regulation 22
4 Regulation 22(2) of the principal Regulations is revoked and the
following is substituted:

" (2) Without prejudice to anything contained in
paragraph (1), where a person licensed by the Minister
under any provision of these Regulations—

(a) has violated a term or condition of his
licence; or

(b) has been found guilty of an offence
against these Regulations,

the Minister may, in his discretion, after giving the
person concerned an opportunity to be heard, suspend
or revoke the licence the term or condition of which was
violated or in relation to which the offence was
committed.".
