WATER RESOURCES AMENDMENT ACT 1998

WHEREAS it is expedient to amend the Water Resources Act
1975:
Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:
Citation
1 This Act may be cited as the Water Resources Amendment Act
1998.
Amendment of section 1 of the Act
2 Section 1(1) of the Water Resources Act 1975 ("the Act") is
amended—
(a) by deleting the definition of "Authority" and substituting
the following:
""Authority" means the Environmental Authority
established by section 3 of the Clean Air Act 1991;";
(b) by deleting the definition of "Chief Engineer" and
substituting the following:

""Environmental Engineer" means the Environmental
Engineer of the Ministry of the Environment";
(c) by deleting the definition of "Minister" and substituting
the following:
""Minister" means the Minister responsible for the
Environment;".
Repeal of section 2 of the Act
3 Section 2 of the Act is repealed.
Amendment of section 31 of the Act
4 Section 31(1) of the Act is amended by deleting the words "Chief
Engineer" and substituting the words "Environmental Engineer".
Amendment of section 33 of the Act
5 Section 33 of the Act is amended by deleting the words "Chief
Engineer" wherever they occur and substituting the words
"Environmental Engineer".
Amendment of section 37 of the Act
6 Section 37 of the Act is amended—
(a) in subsection (1), by deleting the words "$2,000" and
substituting the words "$10,000";
(b) in subsection (2), by deleting the words "$1,000" and
substituting the words "$5,000";
(c) in subsection (3), by deleting the words "$100" and
substituting the words "$1,000".
Amendment of section 39 of the Act
7 Section 39(3) of the Act is amended by deleting the words
"$1,000" and substituting the words "$5,000".
Repeal of section 42 of the Act
8 Section 42 of the Act is repealed.
Repeal of the Schedule to the Act
9 The Schedule to the Act is repealed.
Transitional provisions
10 Any matter which is before the Water Authority on the date this
Act comes into operation shall continue to be dealt with by the Water

Authority until the matter is determined, as if this Act had not been
enacted.
Consequential amendments
11 The consequential amendments set out in the Schedule shall
have effect.
Dissolution of Water Authority
12 The Water Authority is dissolved on such date as the Minister
responsible for the Environment may appoint by notice published in the
Gazette.
SCHEDULE
CONSEQUENTIAL AMENDMENTS
The Water Resources (Appeals to the Minister) Regulations 1976
are amended—
(a) in Regulations 1, 4(2), 5(1) and (2), 6, 8(1), 15(3) and (4)
and 17, by deleting the words "Chief Engineer" or "Chief
Engineer's" wherever they occur and substituting the
words "Environmental Engineer" or "Environmental
Engineer's" respectively;
(b) in Regulations 2(1)(b), 4(1), 7(1) and 7(2)(d), by deleting
the words "Works and Engineering" and substituting the
words "the Environment".
The Water Resources (Well Diggers) Regulations 1976 are
amended—
(a) in Regulations 5(2), 6(2) and 7, by deleting the words
"Chief Engineer" wherever they occur and substituting
the words "Environmental Engineer";
(b) in Regulations 6(2) and the note to Form 2, by deleting
the words "Works and Engineering" and substituting the
words "the Environment";
(c) in Form 1, by deleting the word "Water" before the word
"Authority";
(d) in Form 2, by deleting the head and substituting the
following:
