MOTOR CAR AMENDMENT ACT 1998

WHEREAS it is expedient to amend the Motor Car Act 1951:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation and commencement
1 This Act which amends the Motor Car Act 1951 (hereinafter
referred to "the principal Act") may be cited as the Motor Car Amendment
Act 1998 and shall come into operation on 1 April 1998.

Amends section 2 of principal Act
2 Section 2 of the principal Act is amended—

(a) by inserting next after the definition of the expression
"length overall" the following—

""minibus" means a motor car, being a motor car (other
than an airport limousine or an omnibus) which has
seating accommodation for not less than eleven

passengers, and which is lawfully used for the
conveyance of passengers for hire or reward;"; and

(b) in the definition of the expression "public service
vehicle", by inserting next after the word "omnibus" the
words "a minibus".

Amends section 32 of principal Act
3 Section 32 of the principal Act is amended—

(a) in the heading to the section, by inserting at the end
thereof the words "and minibuses";

(b) in subsection (1), by inserting next after the word
"omnibuses" the words "or minibuses, or both";

(c) in subsection (2), by inserting next after the word
"company", the words "or an approved minibus
company" and by inserting at the end of the subsection
the words "or a minibus"; and

(d) in subsection (3)—

(i) by inserting next after the word "company"
where it first appears the words "and approved
minibus company"; and

(ii) by inserting next after the words "operating
omnibuses" the words "or minibuses, as the case
may be,".

Amends First and Second Schedules to principal Act
4 The principal Act is amended—

(a) in the First Schedule, by deleting the heading "B
AIRPORT LIMOUSINES" and substituting the heading
"B AIRPORT LIMOUSINES AND MINIBUSES"; and

(b) in the Second Schedule—

(i) by inserting at the end of the heading "D.
TRUCKS, TANK WAGONS AND TRACTORS NOT
ELSEWHERE SPECIFIED IN THIS SCHEDULE"
the words "The fees specified in this paragraph
shall be reduced by 50 per cent in the case of a
tank wagon employed exclusively in the
transport of water,"; and

(ii) by inserting at the end thereof the following—

"M MINIBUSES
Any minibus $240.00".
