BERMUDA AIR TERMINAL (FEES) AMENDMENT
REGULATIONS 1997

[made under section 6(2)(k) of the Civil Airports Act 1949 [title 23 item 1]
and brought into operation on 4 April 1997]

Citation
1 These Regulations which amend the Bermuda Air Terminal
(Fees) Regulations 1952 (hereinafter referred to as "the principal
Regulations") may be cited as the Bermuda Air Terminal (Fees)
Amendment Regulations 1997.

Amends regulations 2 of principal Regulations
2 Regulation 2 of the principal Regulations is amended by
inserting next after the definition of the expression "civil aircraft" the
following—

" "gross weight", in relation to—

(a) a civil aircraft, means the maximum take-off weight
authorized by the current certificate of airworthiness
issued in respect of that aircraft by the State in which
that aircraft is registered; and

(b) a military aircraft, means the maximum take-off weight
authorized by the State of which the military aircraft is
the property.".

Amends regulation 3 of principal Regulations
3 Regulation 3 of the principal Regulations is amended by—

(a) by deleting the words "every civil aircraft" and
substituting the words "every aircraft"; and

(b) in the proviso thereto by deleting the words "a civil
aircraft" and substituting the words "an aircraft".

Amends regulation 4 of principal Regulations
4 Regulation 4 of the principal Regulations is amended in
paragraph (3) by inserting next after the words "to be paid" the words "by
or on behalf of the owner or operator of a civil aircraft".

Amends First Schedule to principal Regulations
5 The First Schedule to the principal Regulations is amended—

(a) in the heading thereto, by deleting the word "civil";

(b) in paragraph 1, by deleting the definition of the
expression "gross weight";

(c) by deleting the definition of the expression "weight of air
cargo" and substituting the following—

" "weight of air cargo" in relation to—

(a) a civil aircraft, means the weight of the total
cargo (excluding mail) consigned to or from
Bermuda or for trans-shipment in Bermuda as
shown on the [General Declaration] for the
aircraft; and

(b) a military aircraft, means the weight of the total
cargo as shown on the General Declaration for
that aircraft."; and

(d) by deleting paragraph 2 and substituting the following—

" (2) The assessment of the amount of the
terminal fees to be paid in respect of the use of the
Bermuda Air Terminal by aircraft shall be based on—

(a) the gross weight of the aircraft;

(b) in the case of a civil aircraft
only, on its arrival passenger
load; and

(c) on the weight of its air cargo,

and such assessment shall be at the rates set out in the
following Table.".

Amends Second Schedule to principal Regulations
6 The Second Schedule to the principal Regulations is amended in
paragraph 1, by deleting the definition of the expression "gross weight of
aircraft".
