MOTOR CAR AMENDMENT (NO. 4) ACT 1997

WHEREAS it is expedient to amend the Motor Car Act 1951:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act which amends the Motor Car Act 1951 may be cited as
the Motor Car Amendment (No. 4) Act 1997.

Amends section 52 of Motor Car Act 1951
2 Section 52 of the Motor Car Act 1951 is amended by deleting
subsection (2) and substituting the following—

" (2) No person shall—

(a) use or cause or allow any other person
to use on the highways of Bermuda—

(i) a motor car, other than a motor
cycle; or

(ii) a motor cycle; or

(b) keep or cause or allow any other person
to keep, in a public place, a motor car
other than a motor cycle; or

(c) keep or cause or allow any other person
to keep, in a public place, a motor cycle,

unless a motor car licence has been issued by the
Minister and is in force in respect of that motor car.".

Amends Traffic Offences (Penalties) Act 1976
3 The provisions of the Traffic Offences (Penalties) Act 1976
specified in the first column of the Schedule are amended in the manner
specified in the second column of the Schedule.

TRAFFIC OFFENCES (PENALTIES) ACT 1976

Provision Amendment

First Schedule In the provisions relating to section 17(2) of the
Auxiliary Bicycles Act 1954—

(a) by deleting Head 3 and substituting the
following—

"Head 3: Using or allowing the use of an
unlicensed auxiliary bicycle on a
highway or keeping or allowing or
causing the keeping of an
unlicensed auxiliary bicycle in a
public place"; and

(b) by deleting Head 5 and substituting the
following—

"Head 5: $450".

Delete all the heads relating to section 52(2) of the
Motor Car Act 1951 and substitute the following—

"Head 1: Motor Car Act 1951

Head 2: section 52(2)(a)(i)

Head 3: using or allowing use of an unlicensed
motor car other than a motor cycle

Head 4: summary

Head 5: $1,000

Head 3: Using or allowing use of unlicensed motor
