THE MARINE BOARD AMENDMENT ACT 1997

WHEREAS it is expedient to amend the Marine Board Act 1962:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation
1 This Act which amends the Marine Board Act 1962 (hereinafter
referred to as "the principal Act") may be cited as the Marine Board
Amendment Act 1997.

Amends section 2 of principal Act
2 Section 2 of the principal Act is amended—

(a) by inserting immediately before the definition of the
expression "boat" the following—

" "barge" means a craft—

(a) made or adapted for the purpose of transporting
material and equipment;

(b) used or intended to be used for the purpose of
dredging; or

(c) made or adapted for the purpose of carrying out
marine construction works,

within the territorial waters of Bermuda but does not
include such a craft unless it is used for commercial
purposes;";

(b) in the definition of the expression "boat" by inserting
next after the word "ship" the words "and includes a
barge"; and

(c) by inserting next after the definition of the expression
"licensed pilot" the following—

" "marine construction works" includes any works
carried out on the bed of the sea;".

Amends section 78 of principal Act
3 Section 78 of the principal Act is amended in subsection (1) by
deleting paragraph (a) and substituting the following—

"(a)with respect to the registration, classification and
licensing of any boat—

(i) used for carrying passengers or cargo; or

(ii) used for any other purpose,

within the territorial waters of Bermuda, and for specifying the
conditions subject to which such registration, classification or licensing
may from time to time be renewed, amended or cancelled;".

Inserts new section 103A in principal Act
4 The principal Act is amended by inserting next after section 103
the following—

"Penalty for late payment of light tolls, etc.
103A Where—

(a) light tolls payable pursuant to section 25;

(b) pilotage dues payable pursuant to section 63;

(c) increased pilotage dues payable pursuant to section
65 or 66;

(d) wharfage payable pursuant to any provision of law;

(e) port dues payable pursuant to section 76; or

(f) dues payable in respect of sea-borne services
pursuant to section 97,

have not, within a period of forty-five days commencing on the
date of a demand therefor, been paid by the person liable to
make such payment there shall thereafter, in addition to the
amount specified in the demand, be payable by the person so
liable a penalty in the amount of ten per centum of the amount
for which the demand was made, and the provisions of sections
26 and 108 shall apply to every such penalty levied in respect of
light tolls and pilotage dues.".
