MARINE BOARD (PROHIBITED AREAS DESIGNATION) NOTICE
1996

[made under section 10 of the Marine Board Act 1962 [title 22 item 3] and
brought into operation on 14 June 1996]

Citation
1 This Notice may be cited as the Marine Board (Prohibited Areas
Designation) Notice 1996.

Prohibited areas
2 (1) Save under the terms of any permission granted in writing
by the Minister, the owner, operator or pilot of a boat shall not approach
within 50 meters of the hull of a ship moored or anchored in the areas of
waters designated in the Schedule.

(2) Sub-paragraph (1) does not apply to the operator or pilot of
a boat owned by the Government.

Evidence
3 The onus of proving that an owner, operator or pilot of a boat
has written permission to be in a prohibited area shall be on the person
asserting that fact.
