BERMUDA AIR TERMINAL (FEES) AMENDMENT
REGULATIONS 1995

The Minister in exercise of the power conferred upon him by
section 6(2)(k) of the Civil Airports Act 1949 makes the following
Regulations:

Citation
1 These Regulations which amend the Bermuda Air Terminal
(Fees) Regulations 1952 (hereinafter referred to as "the principal
Regulations") may be cited as the Bermuda Air Terminal (Fees)
Amendment Regulations 1995.

Amends regulation 2 of principal Regulation
2 Regulation 2 of the principal Regulations is amended by
inserting next after the definition of the expression "civil aircraft" the
following—

"United States Pre Clearance" means clearance, at the Bermuda
Air Terminal, by United States of America Federal Inspection
Personnel, of a person intending to travel from Bermuda to,
or transitting, the United States of America, such clearance
being intended to determine—

(a) whether that person is liable to pay any customs duties;

(b) the status of the person in respect of residence in the
United States of America; and

(c) whether the person is intending to import into the
United States of America any prohibited goods, including
agricultural products.".

Revokes and replaces regulation 3 of principal Regulations
3 Regulation 3 of the principal Regulations is revoked and replaced
by the following—

"Fees
3 (1) Subject to paragraph (3), the fees set out in, and
assessed in accordance with, the First and Second Schedules
shall be paid by or on behalf of the owner or operator of every
civil aircraft which uses, or, as the case may be, remains in, the
Bermuda Air Terminal.

(2) The fees set out in the Third Schedule shall be paid
by or on behalf of the owner or operator of every civil aircraft in
respect of United States Pre Clearance of a person.

(3) Notwithstanding paragraph (1), the General
Manager of Airport Operations may, subject to such general or
special directions as the Minister may give in that behalf, declare
that no fee, or part only of the fee otherwise payable shall be
paid in respect of the use of the Bermuda Air Terminal by a civil
aircraft in circumstances which could not be avoided.".

Inserts new Third Schedule into principal Regulations
4 The principal Regulations are amended by inserting next after
the Second Schedule the following—

" THIRD SCHEDULE (regulation 3(2))

UNITED STATES PRE CLEARANCE FEE

For each enplaned passenger $0.48.".
