CIVIL AIRPORTS LANDING FEES AND VALIDATION ACT 1995

WHEREAS it is expedient to make provisions in respect of
landing fees at the Bermuda Airport and to validate certain landing fees
which were charged and collected by the Minister:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Short title
1 This Act may be cited as the Civil Airports Landing Fees And
Validation Act 1995.

Interpretation
2 In this Act—

"Bermuda Airport" has the meaning assigned to that expression
by section 1 of the Civil Airports Act 1949;

"gross weight of aircraft" means the maximum take-off weight
authorized by the current certificate of airworthiness issued
in respect of an aircraft by the State in which that aircraft is
registered;

"landing fees" means fees payable in respect of an aircraft which
lands at the Bermuda Airport; and

"Minister" has the meaning assigned to that expression by
section 1 of the Civil Airports Act 1949.

Landing fees, etc.
3 (1) The landing fees payable in respect of an aircraft shall be
$2.80 per 1000 pounds gross weight of aircraft.

(2) The Minister may, by Regulations made under section
6(2)(k) of the Civil Airports Act 1949, vary the amount of the landing fees
specified in subsection (1); and, upon the coming into operation of such
Regulations, subsection (1) shall cease to have effect.

Validation of landing fees
4 Where, prior to the coming into operation of this Act, the
Minister had charged and collected any landing fees, such landing fees
shall, on the coming into operation of this Act, be deemed to have been
validly charged and collected and no action, suit or proceeding shall be
brought against the Minister by reason only of such charge or of such
collection.
