AUXILIARY BICYCLES AMENDMENT (N0. 3) ACT 1995

WHEREAS it is expedient further to amend the Auxiliary Bicycles
Act 1954:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation
1 This Act which amends the Auxiliary Bicycles Act 1954 may be
cited as the Auxiliary Bicycles Amendment (No. 3) Act 1995.

Amends section 1 of Auxiliary Bicycles Act 1954
2 Section 1 of the Auxiliary Bicycles Act 1954 is amended by
deleting the definition of the expression "driver's licence" and
substituting the following—

" "driver's licence" means a driver's licence issued under section
9;".

Amends section 9 of Auxiliary Bicycles Act 1954
3 Section 9 of the Auxiliary Bicycles Act 1954 is amended—

(a) by deleting subsections (1), (2) and (3) and substituting
the following—

" (1) No person who resides in Bermuda shall
drive a private auxiliary bicycle or a livery auxiliary
bicycle unless he holds a valid driver's licence.

(2) No person shall cause or allow any other
person who resides in Bermuda to drive a private
auxiliary bicycle or a livery auxiliary bicycle unless that
other person holds a valid driver's licence.

(3) For the purposes of this section a driver's
licence valid for the driving of a private auxiliary bicycle
or a livery auxiliary bicycle shall be issued to any person
over the age of sixteen years who—

(a) makes application to the Minister
therefor;

(b) produces a certificate of physical fitness;

(c) passes the driving examination referred
to in subsection (3A); and

(d) pays the fee prescribed in respect of
such examination and driver's licence.";
and

(b) by inserting next after subsection (3) the following—

" (3A) For the purposes of subsection (3)(c) an
examination by an examiner or other person approved,
in writing, by the Minister to assess the competence of a
person to drive a private auxiliary bicycle or a livery
auxiliary bicycle shall include such tests as may be
prescribed, or, if tests are not prescribed, such test as
the examiner, or other person, with the approval of the
Minister, may think desirable.".

Amends section 10 of Auxiliary Bicycles Act 1954
4 Section 10 of the Auxiliary Bicycles Act 1954 is amended by
deleting subsection (1) and substituting the following—

" (1) A person who resides in Bermuda and who is
driving, or for the time being is in charge of, a private auxiliary
bicycle or a livery auxiliary bicycle, on any road shall carry with

him his driver's licence and shall produce his driver's licence for
inspection when so required by a police officer or by a traffic
warden.".
