AUXILIARY BICYCLES AMENDMENT (No. 2) ACT 1995

WHEREAS it is expedient to amend the Auxiliary Bicycles Act
1954:

Be it enacted by The Queen's Most Excellent Majesty, by and
with the advice and consent of the Senate and the House of Assembly of
Bermuda, and by the authority of the same, as follows:

Citation
1 This Act which amends the Auxiliary Bicycles Act 1954 may be
cited as the Auxiliary Bicycles Amendment (No. 2) Act 1995.

Amends section 18 of Auxiliary Bicycles Act 1954
2 Section 18 of the Auxiliary Bicycles Act 1954 is amended—

(a) in subsection (1), by deleting the words "An auxiliary
bicycle" and substituting the words "Subject to
subsections (6) and (7), an auxiliary bicycle"; and

(b) by inserting next after subsection (5) the following—

"(6) The Minister may, in the case of a new auxiliary
bicycle, other than an auxiliary bicycle purchased

otherwise than through a dealer, authorize a dealer to
examine the auxiliary bicycle.

(7) Where, pursuant to subsection (6), a dealer
examines an auxiliary bicycle and the dealer certifies —

(a) that the auxiliary bicycle is not an auxiliary
bicycle purchased otherwise than through a
dealer;

(b) that the auxiliary bicycle is new;

(c) that the auxiliary bicycle has been examined by
him; and

(d) that the auxiliary bicycle is fit for use on the
roads of Bermuda,

that auxiliary bicycle shall be deemed to have been
examined pursuant to subsection (1).

(8) In this section "dealer" means a dealer in auxiliary
bicycles.".
