CHAPTER 151

LOTTERIES CONTROL REGULATIONS (Section 5)

[23rd July, 1966.]

1. These Regulations may be cited as the

LOTTERIES CONTROL REGULATIONS.

2. In these Regulations-

“Boledo lottery” means the lottery in which the winning number comprises two digits and is drawn in accordance with the provisions of sub-regulation (2) of Regulation 3 of these Regulations;

“games evening” shall include any occasion whether in the evening or not on which games of chance are to be played;

“Jackpot lottery” means the lottery in which the winning number comprises four digits and which is drawn in accordance with the provisions of sub-regulation (1) of Regulation 3 of these Regulations;

“Ordinary lottery” is the lottery in which the winning number comprises the last two digits of the winning number of the jackpot Lottery;

“promote” and its grammatical variations shall include “conduct” and “hold” and their grammatical variation.

3. (1) A lottery shall be held weekly except as may otherwise be notified by the Committee and the winning numbers in respect of the jackpot

lottery and the Ordinary lottery, shall be drawn at such time and place and in such manner as the Committee may direct.

(2) The Boledo lottery shall be held daily except Saturdays, Sundays and public holidays, and the winning number, being a number of two digits, shall be drawn at such time and place and in such manner as the Committee shall direct.

4. (1) Subject to the provisions of sub-regulation (4) of this Regulation the prizes payable in the jackpot lottery shall be-

(a) one hundred and fifty dollars to the holder of every ticket bearing the four-figure number drawn as the first winning number in the Jackpot lottery;

(b) fifty dollars to the holder of every ticket bearing the four figure number drawn as the second winning number in the Jackpot lottery;

(c) twenty dollars to the holder of every ticket bearing the four figure number drawn as the third winning number in the Jackpot lottery;

(d) two dollars to the holder of every ticket bearing a number the last two figures of which are the same as the last two figures of the first winning number drawn in the Jackpot lottery:

Provided that where the holder of a ticket has purchased more than one piece of the same number on a ticket he shall be paid the appropriate prize for each such piece purchased.

(2) Subject to the provisions of sub-regulation (4) of this Regulation the prize payable in the Ordinary lottery to the holder of every ticket bearing

the winning number shall be eleven dollars.

(3) Subject to the provisions of sub-regulation (4) of this Regulation the prize payable in the Boledo lottery to the holder of every ticket bearing the winning number shall be three dollars and fifty cents.

(4) The Committee may, upon application by a licensee and subject to compliance by the licensee with the provisions of these Regulations, permit the licensee to increase the prize offered in any lottery.

(5) Any application made to increase the prizes offered in respect of any lottery shall be accompanied by a fee of five dollars:

Provided that where such application is made at the same time as the application for a licence under the provisions of the Lotteries Act, no such fee shall be payable.

(6) Any person who pays or offers any prize in excess of the sums laid down in sub-regulations (1), (2) or (3) of this Regulation without the consent of the Committee shall be guilty of an offence.

5. (1) The price of a ticket sold in a jackpot lottery shall be ten cents or such multiple of ten cents as the purchaser shall have pieces on the ticket.

(2) The price of a ticket sold in an Ordinary lottery shall be fifteen cents.

(3) The price of a ticket sold in a Boledo lottery shall be five cents:

Provided that the tickets in a Boledo lottery shall be sold in multiples of five of the same number.

6. (1) Every ticket issued for sale in a lottery shall be printed in a form approved by the Committee. There shall be included on every ticket, if not

printed thereon then written in ink, the following particulars:

(a) the date of the draw;

(b) description of the lottery and the number of the ticket, and, in the case of a Jackpot lottery the number chosen by the purchaser;

(c) the price of the ticket;

(d) the prize or prizes payable in respect of the winning number or numbers;

(e) in the case of lotteries other then the Boledo, Ordinary or Jackpot the official Government stamp;

(f) the name of the person promoting the lottery or, in the case of a Boledo, Ordinary or Jackpot lottery, the registered mark of the promoter;

(g) such other particulars as the Committee may from time to time direct.

(2) No person other than the Government Printer shall print any ticket for sale in a Boledo, Ordinary or Jackpot lottery.

(3) No ticket shall be offered for sale or sold in respect of a Boledo or Ordinary lottery to be drawn on any date other than the date printed thereon by the Government Printer.

(4) Any person who alters any of the particulars on a ticket specified in sub-regulation (1) of this Regulation or who sells or offers for sale any ticket on which any of the said particulars have been altered or which does not contain all the particulars set out in sub-regulation (1) of this Regulation

shall be guilty of an offence.

(5) No ticket which remains unsold shall entitle the licensee to a refund of any tax or other monies which he may have paid in respect of such ticket.

7. Winning numbers as determined in Regulation 3 of these Regulations and declared in such manner as the Committee may decide including publication in a daily paper or papers or by means of wireless shall be binding on all persons to whom licences are issued under the provisions of these Regulations.

8. Prizes shall be paid by the person to whom a licence has been issued under these Regulations in respect of tickets bearing winning numbers in a lottery in accordance with the following provisions:

(a) payment shall be claimed by presenting and delivering up the ticket in respect of which the claim is made to the licensee or his agent;

(b) payment shall be claimed within a period of thirty days from the day after the day of the draw at which the ticket in respect of which the claim is made was declared a winning ticket;

(c) payment shall be made at the time of such presentation to the person who presents the ticket for payment of the prize won by that ticket, and such payment shall absolutely discharge the person to whom the licence was issued in respect of the payment of that prize.

9. If payment of a prize is not claimed in the manner and within the period prescribed by Regulation 8 aforesaid, the prize shall cease to be payable.

10. If, when any ticket is presented for payment of a prize any number, mark, figure or word which is material for identifying the ticket is, in the opinion of the licensee illegible, incomplete, has been altered, obliterated, defaced or removed or if the ticket was not sold by him or his agent, he shall not make payment unless the person claiming payment produces evidence, identifying the ticket as the ticket in respect of which the prize is payable and that it was sold to him.

11. Any person dissatisfied with the decision of the licensee may give notice of such dissatisfaction to the licensee and to the Committee, and the licensee shall thereupon at the request of the Committee refer the matter forthwith to the Committee for arbitration.

12. (1) An application for a licence to promote a lottery shall be in the appropriate form set out in the First Schedule to these Regulations and shall be accompanied by such fee as may be payable under section 7 of the Act together with, in the case of any application to promote a lottery other than a Jackpot, Ordinary or Boledo lottery, such sum by way of tax as may be payable under section 8 of the Act.

(2) Any person who, in any application for a licence, makes a false statement shall be guilty of an offence.

13. Any application for a licence shall be submitted to the Committee not less than four weeks before the date on which it is desired the licence shall commence.

14. Every applicant for a licence shall include with his application either a statement that he will make a cash deposit or the names of two sureties who will, in the event of the application being successful, enter into a bond for the payment by the applicant of all sums due from him.

15. Subject to the conditions of his licence a person licensed to promote a Jackpot lottery may sell tickets bearing more than one chance on any one

16. (1) An applicant for a licence to promote a Boledo or Ordinary lottery shall state the number of books of tickets which he is applying for licence to sell in respect of any such lottery.

(2) An applicant for a licence to promote a jackpot lottery shall state the number of pieces which he is applying for licence to sell on any particular number.

(3) If the Committee grants a licence it may do so either for the number of books or pieces as the case may be that the applicant is requesting licence to sell or for such lesser number of books or pieces as it may deem fit.

17. (1) The Committee may in its discretion upon any application grant a licence in the form set out in the Third Schedule to these Regulations which shall be subject to such conditions as appear therein.

(2) Any person who is in breach of any of the conditions of a licence granted to him shall be guilty of an offence.

18. Where an applicant has been granted a licence to conduct a lottery, the amount of the cash deposit to be made or the bond to be given by his sureties shall be calculated as follows:

(a) twice the total value of the prizes payable on each book of tickets for each book of tickets in the Boledo lottery that the applicant is licensed to sell;

(b) twice the total value of the prizes payable on each book of tickets for each book of tickets in the Ordinary lottery that the applicant is licensed to sell;

(c) $840 for each piece the applicant is licensed to sell on any particular number in the Jackpot lottery:

Provided that where a licensee has been permitted to increase the prizes offered by him in a Boledo, Ordinary or Jackpot lottery the cash deposit to be made on the bond to be given shall be increased by twice the amount as the prizes are increased;

(d) in the case of a lottery which is conducted from any country other than this country twice the face value of tickets to be sold in this country;

(e) in the case of any other lottery twice the total value of the prizes payable in such lottery.

19. A licensee shall within seven days of the grant to him of a licence and before the promotion by him of a lottery authorised by such licence either make a cash deposit with the Committee or deliver to the Committee a bond duly executed in the form set out in the Second Schedule to these Regulations. Such cash deposit or bond shall be in a sum calculated in accordance with Regulation 18 of these Regulations.

20. (1) Any person who has been granted a licence under the provisions of these Regulations may appoint agents to act on his behalf in the promotion of the lottery authorised by such licence:

Provided that no person shall be appointed as an agent who would be ineligible to be granted a licence by virtue of the provisions of section 6 (3) (b) or (c) of the Act or who is under the age of 16 years:

Provided further that the Committee may at any time revoke any such appointment.

(2) A licensee shall, seven days before any agent acts under his appointment, notify in writing the Committee and the Commissioner of Police of such appointment.

(3) A licensee who fails to submit such notification of appointment as required in sub-regulation (2) of this Regulation or who after such appointment has been revoked by the Committee, continues to employ such a person as an agent or who appoints as an agent a person who is not eligible to be so appointed by reason of the provisions of sub-regulation (1) of this Regulation, shall be guilty of an offence.

(4) For the purposes of this regulation “agent” shall be deemed to include any person who assists in the promotion of a lottery whether by advertisement, selling of tickets or in any other way whatsoever.

(5) No licensee shall allow any tickets to be sold other than by himself or by an agent appointed by him.

(6) A licensee shall before the sale of any tickets in a lottery cause to be placed on each ticket his name and address or, in the case of a Boledo, Ordinary or Jackpot lottery the mark which has been registered by him in accordance with these Regulations.

(7) A licensee who fails to comply with the provisions of subregulations (3), (5) and (6) of this Regulation shall be guilty of an offence.

21. Any licensee or agent who buys, receives, takes or accepts a winning ticket from any person other than on payment of the prize payable in respect of such ticket shall be guilty of an offence.

22. (1) Any person who is guilty of an offence under these Regulations shall be liable on summary conviction to a fine not exceeding two hundred and fifty dollars.

(2) Where any person is convicted of any offence under these Regulations the Committee may in its discretion if such person be a licensee revoke his licence or, if such person be an agent, revoke the licence of such agent’s principal.

23. The Committee may appoint Inspectors to supervise the drawing of any locally operated lottery.

CHAPTER 151

LOTTERIES CONTROL (INSTANT LOTTERY) REGULATIONS (Section 5)

[4th September, 1993.]

1. These Regulations may be cited as the

LOTTERIES CONTROL (INSTANT LOTTERY) REGULATIONS.

2. In these Regulations, unless the context otherwise requires-

“Act” means the Lotteries Control Act;

“instant lottery” means a game of chance where a person can claim a prize instantly if he is a winner;

“lottery” means the instant lottery.

3. The lottery will be played on a continuous basis and the winning number will be as prescribed by the game.

4. The price of a ticket sold in a lottery shall be one dollar.

5. (1) Every ticket issued for sale in a lottery shall be printed in a form approved by the Committee. There shall be printed on every ticket the following particulars:

(a) description of the lottery game and the number of the ticket;

(b) the price of the ticket;

(c) the prize or prizes payable in respect of the winning number or numbers;

(d) the rules of the lottery; and

(e) such other particulars as the Committee may from time to time direct.

(2) Any person who alters any of the particulars on a ticket specified in sub-regulation (1) of this Regulation or who sells or offers for sale any ticket on which any of the said particulars have been altered or which does not contain all the particulars set out in sub-regulation (1) of this Regulation shall be guilty of an offence.

6. (1) The prizes payable shall be as the winning ticket stipulates - $1000, $500, $250, $100, $50, $25, $10, $5, $4, $3, $2, $1 and free tickets.

(2) The Committee may, upon application by a licensee and subject to compliance by the licensee with the provisions of these Regulations, permit the licensee to increase the prize offer in any game.

(3) Any person who pays or offers any prize in excess of the sums laid down in sub-regulations (1) and (2) of this Regulation without the consent of the Committee, shall be guilty of an offence.

7. No ticket which remains unsold shall entitle the licensee to a refund of any tax or other monies which he may have paid in respect of such ticket.

8. Prizes shall be paid by the person to whom a licence has been issued under these regulations in respect of tickets bearing winning numbers in a lottery in accordance with the following provisions--

(a) payment shall be claimed by presenting and delivering the ticket in respect of which the claim

is made to the licensee or his agent;

(b) prizes of free tickets up to one hundred dollars ($100.00) may be collected immediately from any official lottery agent;

(c) prizes of one hundred dollars and more may be collected from the licensee;

(d) payments shall be claimed within a period of one hundred and eighty days;

(e) payments shall be made at the time of such presentation to the person who presents the ticket for payment of the prize won by that ticket, and such payments shall absolutely discharge the person to whom the licence was issued in respect of the payment of that prize.

9. Where the payment of a prize is not claimed in the manner and within the period prescribed, by Regulation 8, the licensee may refuse to pay the prize.

10. If, when any ticket is presented for payment of a prize, any number, mark, figure or word which is material for identifying the ticket is, in the opinion of the licensee illegible, incomplete, has been altered, obliterated, defaced, or fails any lottery validation requirements, or if the ticket was not sold by the licensee or his agents, he shall not make payment unless the person claiming payment produces evidence, identifying the ticket as the ticket in respect of which the prize is payable and that it was sold to him.

11. (1) Any person dissatisfied with the decision of the licensee may give notice of such dissatisfaction to the licensee and to the Committee, and the licensee shall thereupon at the request of the Committee refer the matter

forthwith to the Committee for arbitration.

(2) The Committee may arbitrate between the parties informally and shall not be bound to follow the strict rules of evidence and procedure. The decision of the Committee in any such arbitration shall be final and binding on the parties.

12. (1) An application for a licence to promote a lottery shall be in the appropriate form set out in Schedule A to these Regulations and shall be accompanied by such fee as may be payable under section 7 of the Act or such sum by way of tax as may be payable under section 8 of the Act.

(2) Any person who, in any application for a licence, makes a false statement shall be guilty of an offence.

13. Every applicant for a licence shall include with his application either a statement that he will make a cash deposit, or the names of two referees who will, in the event of the application being successful, enter into a bond for the payment by the applicant of all sums due from him.

14. (1) The Committee may, in its discretion upon any application, grant a licence in the form set out in Schedule B to these Regulations which shall be subject to such conditions as appear therein.

(2) Any person who is in breach of any of the conditions of a licence granted to him shall be guilty of an offence.

15. (1) Any person who has been granted a licence under the provisions of these Regulations may appoint agents to act on his behalf in the promotion of the lottery authorised by such licence:

Provided that no person shall be appointed as agent who would be ineligible to be granted a licence under the provisions of section 6 (3) (b) or (c) of the Act or who is under the age of 18 years:

Provided further that the Committee may at any time revoke any such appointment.

(2) A licensee shall, at least seven days before any agent acts under his appointment, notify in writing to the Committee and the Commissioner of Police of such appointment.

(3) A licensee who fails to submit such notification of appointment as required in sub-regulation (2) of this Regulation, or who after such appointment has been revoked by the Committee continues to employ such a person as agent, or who appoints as an agent a person who is not eligible by reason of the provision of sub-regulation (1) of this Regulation shall be guilty of an offence.

(4) For the purpose of this Regulation, “agent” shall be deemed to include any person who assists in the promotion of a lottery whether by advertisement, selling of tickets or in any other manner whatsoever.

(5) No licensee shall allow any tickets to be sold other than by himself or by an agent appointed by him.

(6) A licensee who fails to comply with the provisions of this regulation shall be guilty of an offence.

16. Any licensee or agent who buys, receives, takes or accepts a winning ticket from any person other than on payment of the prize in respect of such ticket shall be guilty of an offence.

17. (1) Any person who is guilty of an offence under these Regulations shall be liable on summary conviction to a fine not exceeding five hundred dollars.

(2) Where any person is convicted of any offence under these Regulations, the Committee may in its discretion, if such a person be a licensee,

revoke his licence, or if such a person be an agent, revoke the licence of such agent’s principal.

18. These Regulations shall take effect from 1st April, 1993.

CONDITIONS OF LICENCE

1. Tickets sold shall be in the Form approved by the Lotteries Committee.

2. Tickets sold shall bear the private mark registered with the Lotteries Committee.

3. The Licensee shall register the names of his agents with the Lotteries Committee.

4. Tickets issued to the Licensee shall only be sold by the licensee or such of his agents as are registered with the Lotteries Committee.

5. The Licensee shall obey and give effect without question to every decision made by the Lotteries Committee under these Regulations and conveyed in writing to the Licensee.

6. The Licensee shall not buy, receive, take or accept from any person a winning ticket otherwise than in consideration of the prize payable in respect of that ticket.

7. The Licensee shall at all times during the term of his licence, observe the provisions of the Lotteries Control Act and these Regulations.

8. Payments to Accountant General should be made at the end of each month and within seven (7) working days after the end of each month.

9. A penalty of 1% per month on amount due will be payable to Government of Belize in cases of late payment.

10. A statement of Revenue Sales must be submitted along with monthly payments to Government of Belize.

11. If it is proved that a false statement is made then the Licensee will be charged 15% of the Gross Revenue without prejudice to any criminal liability that may be incurred by the Licensee in that behalf.

12. An Annual Audited statement of Accounts must be submitted to the Accountant General within 3 months of the close of the Licensee’s financial year.

13. A Small Business Development Fund must be set up by the Licensee.

14. If the Licensee defaults in payment of prizes, the licence may be revoked.

15. If the Licensee defaults in making payments to the Government of Belize for 3

consecutive months, the licence may be revoked.

CHAPTER 151

LOTTERIES CONTROL (VARIATION OF FEES) ORDER (Section 7)

[30th March, 2002.]

1. This Order may be cited as the

LOTTERIES CONTROL (VARIATION OF FEES) ORDER.

2. The fees specified in section 7(1)(b) of the Lotteries Control Act in respect of a licence for promoting, holding or conducting a lottery are hereby varied as follows:-

(i) for a quarter - twenty five dollars;

(ii) for a half year period - fifty dollars;

(iii) for a year - one hundred dollars.

3. This Order shall take effect from 1st April, 2002.
