PENSIONS (WEST INDIES DISSOLUTION)

[16th January, 1965]

1. This Act may be cited as the Pensions (West Indies Dissolution) Act.

2. The persons mentioned in Schedule I to the Agreement set out in the Schedule to this Act shall, upon happening of the events set out in clause 2 of the said Agreement, be paid the sums due to them under the said Agreement calculated in accordance with the terms of the said clause 2.

ter referred to as “the Government”).

WHEREAS under the provisions of the West Indies (Pensions) Order 19641 (hereinafter referred to as “the Order in Council”) the Commissioner is empowered to enter into arrangements with any person or authority for the payment by that person or authority, in lieu of all or part of any pension payable by the Commissioner to any person under any law, of a pension or annuity of like amount.

AND WHEREAS it is desired that in respect of certain pensions for service under the West Indies Federation, or the Commissioner, such arrangements shall be made between the Commissioner and the Govern- ment in respect of the officers named in Schedule I to this Agreement who are now in the service of the Government.

IT IS HEREBY AGREED as follows:-

1. The Commissioner shall pay to the Government the sum of three thousand one hundred and eighty-eight West Indian dollars ($W.I. 3,188) being the sum which according to actuarial calculation is necessary to enable the Government to give effect to clause 2 of this Agreement. The sum referred to in this paragraph shall be transferred to the Government as soon as may be after the date upon which, in accordance with clause 3 of this Agreement, the Government notifies the Commissioner that the law referred to therein is validly in force.

2. The Government shall, upon the retirement from its service of each person named in Schedule I to this Agreement in accordance with the law in force in the territory of that Government or to his dependents upon the death of such person while so serving or after such retirement, pay an annual sum in respect of the service of such person under the Federation of the West Indies or the Commissioner which shall be computed at rates and under conditions, not less favourable to such person or his dependents, than would have been the case if such annual sum had fallen to be computed and

paid under the appropriate law. For the purpose of this clause “the appropri- ate law” means any law set out in Schedule 2 of this Agreement which, but for the Order in Council would have applied to such person.

3. The Government shall enact legislation so that effect may be given to the provisions of clause 2 of this Agreement.
