1              Name of Rules                 These Rules are the Federal Court Amendment Rules 2005 (No. 3). 2              Commencement                 These Rules commence on 6 February 2006. 3              Amendment of Federal Court Rules                 Schedule 1 amends the Federal Court Rules.

Schedule 1        Amendments (rule 3)    [1]           Order 1, rule 4, after definition of Australia insert Bankruptcy Rules means the Federal Court (Bankruptcy) Rules 2005. [2]           Order 1, paragraph 5A (2) (c) omit Order 77, paragraph 19 (6) (b) insert paragraph 4.07 (b) of the Bankruptcy Rules [3]           Order 62, subrule 8 (2) substitute          (2)   Unless the taxing officer appoints a time for taxation under subrule 41 (1), a bill will be assessed in accordance with rule 46.          (3)   In subrule (2): bill does not include a short form bill under:                 (a)    rule 40A; or                (b)    rule 40B; or                 (c)    rule 13.03 of the Bankruptcy Rules. [4]           Order 62, subrule 39 (1A) substitute       (1A)   The Registrar or a District Registrar may authorise an officer to be the taxing officer for the purposes of taxing a short form bill filed under the following provisions:                 (a)    rule 40A;                (b)    Division 13.2 of the Bankruptcy Rules. Order 77      Bankruptcy proceedings Note   For the rules governing proceedings in the Court under the Bankruptcy Act 1966, see the Federal Court (Bankruptcy) Rules 2005.
