1              Name of Determination                 This Determination is the Declared Hearing Services Amendment Determination 2005 (No 1). 2              Commencement                 This Determination commences on 1 December 2005. 3              Amendment of Declared Hearing Services Determination 1997                 Schedule 1 amends the Declared Hearing Services Determination 1997.

Schedule 1        Amendments (section 3)    [1]           Subsection 3(1), definition of Aboriginal person substitute Aboriginal person has the meaning given by the Aboriginal and Torres Strait Islander Act 2005. [2]           Subsection 3(1), definition of Australian children Repeal the definition. [3]           Subsection 3(1), after the definition of Act insert CDEP Program means the Community Development Employment Projects Program administered by the Department of Employment and Workplace Relations.  [4]          Subsection 3(1), definition of parent substitute parent, in relation to a young Australian, includes a step-parent, adoptive parent, foster parent or legal guardian of the young Australian.  [5]          Subsection 3(1), definition of Torres Strait Islander substitute Torres Strait Islander has the meaning given by the Aboriginal and Torres Strait Islander Act 2005. [6]           Subsection 3(1), after the definition of Torres Strait Islander insert young Australians has the meaning given by subsection 8 (10) of the Act, and young Australian has a corresponding meaning.  [7]          Section 4, heading substitute Class 1 – Young Australians [8]           Section 4 omit Australian children insert young Australians [9]           Paragraph 8(2)(a) omit an Australian child insert a young Australian [10]         Paragraph 12(a)(i) omit an Australian child insert a young Australian [11]         Paragraph 12(d)(ii) substitute (ii)                       over 50; or (iii)           a participant in the CDEP Program; or (iv)          an eligible person.
