Determination 2005/14:
Remuneration and Allowances for Office Holders
          (i)        Pursuant to subsections 7(3) and 7(4) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to holders of public office, and other matters significantly related thereto, and determines as set out below.   (ii)        This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments.   PART 1 – PART TIME OFFICES   1.1       In this part, Determination Number 5 of 2005 (as amended) is referred to as the Principal Determination.   1.2       Table A1A of the Principal Determination is amended by omitting the current entries in Columns 2 to 6 inclusive against the offices listed in Column 1 below, and substituting the following entries.

  1.3       Table A1A of the Principal Determination is amended by omitting the wording of the current footnote 27 attached to the entry “Companies Auditors and Liquidators Disciplinary Board”, and substituting the following footnote:            27CALDB The Deputy Chairman will be paid $854 per diem.  Office holders in CALDB on the date of effect of Determination 2005/14 have the once only option of choosing to maintain their previous remuneration for the balance of their term.  This is – Chairman: Retainer $8,403 p.a., Daily fee $842, Deputy Chair: Retainer $6,767 p.a., Daily fee $842, Member: Retainer $2,499 p.a., Daily fee $694.   1.4       Table A1A of the Principal Determination is amended by omitting the wording of the current footnote 29 attached to the entry “Takeovers Panel”, and substituting the following footnote:            29Takeovers Panel  Daily fees are only payable for sitting days of takeover proceedings and for Panel days.  Remuneration for other business is by way of the annual fee, which is $15,000 for the Chairman and $2,500 for the Members.   1.5     Clause B1.1 of Schedule B of the Principal Determination is amended by deleting the entries for “Review of the Australian Blood Banking and Plasma Product Sector” and “Working Party on the Future of Blood Products in Australia”.            PART 2 – FULL TIME OFFICES   2.1       In accordance with clause 4.2 of Determination 9 of 2002, the Remuneration Tribunal determines that the Chief Executive Officer of the National Health and Medical Research Council, Professor Alan Pettigrew, shall be paid a performance bonus of $13,230 for the period 1 January 2004 to 25 September 2004.   PART 3 – JUDICIAL AND RELATED OFFICES   3.1             In this part, Determination Number 11 of 2005 is referred to as the Principal Determination.   3.2             Clause 2.3 of the Principal Determination is amended by deleting the wording of the current clause and inserting the following:             2.3      Remuneration of part-time office:  Notwithstanding any other provision of this determination, a person who holds office on a part-time basis, other than a member of the National Native Title Tribunal:   (i)                 may not be paid more than the base salary of the equivalent full-time office (if any) in respect of any financial year; and   (ii)               is deemed to hold a full-time office in that year for the purposes of entitlements, other than separation benefits and salary packaging, if paid an amount equal to the base salary of the equivalent full-time office in any given financial year.   2.3.1  Remuneration of Part-Time NNTT Members: Notwithstanding any other provision of this determination, a person who holds office as a member of the National Native Title Tribunal on a part-time basis:   (i)       may not be paid more than the amount calculated as the Total Remuneration of the equivalent full-time office less 15.4 per cent of the full-time office’s Base Salary, in respect of any financial year; and   (ii)      is deemed to hold a full-time office in that year for the purposes of entitlements, other than separation benefits and salary packaging, if paid an amount equal to the amount calculated under 2.3.1 (i) in any given financial year.   PART 4 – FULL TIME OFFICES   4.1             In this part, Determination 6 of 2005 (as amended) is referred to as the Principal Determination.   4.2             Table 3A of Part 3 of the Principal Determination is amended by omitting the entry ‘$25,000’ in Column 3 against Mr S. Somogyi, and substituting the entry ‘$25,500’.   4.3             Clause 3.1.5 is added to the Principal Determination after clause 3.1.4, as follows: 3.1.5   Australian Prudential Regulation Authority   Mr S. Somogyi, Member, is entitled to an additional accommodation allowance of $500 for the period 1 July 2003 to 30 June 2005.  Mr R. Jones, Member, is entitled to an additional accommodation allowance of $500 for the period 1 July 2003 to 30 June 2004.   4.4             Table 2A of Part 2 of the Principal Determination is amended by omitting the entry ‘$96,120’ in Column 3 against ‘Member, SSAT’, and substituting the entry ‘$96,130’.   4.5             Clauses 4.2 and 4.4 take effect on and from 1 July 2005.
