Broadcasting Services (HDTV Demonstration Programs) Determination 2005
    1.       Name of Determination   This determination is the Broadcasting Services (HDTV Demonstration Programs) Determination 2005.   2.       Commencement   This determination commences on 7 August 2005.   3.             Definitions In this determination: specified commercial television broadcasting licensee means all holders of commercial television broadcasting licences for services available in licence areas that are not remote licence areas.   Note:  Pursuant to subclause 5(1) of Schedule 4 to the Broadcasting Services Act 1992, the ACMA may determine that a specified licence area is a remote licence area for the purposes of Schedule 4.  The ABA made a Determination of Remote Licence Areas under subclause 5(1) of Schedule 4 to the Broadcasting Services Act 1992 on 14 December 2000.    specified period means the period commencing on 7 August 2005 and ending 12 months from that date.   4.             Determination - HDTV demonstration programs   Under subclause 37EA(2) of Schedule 4 to the Broadcasting Services Act 1992, the Australian Communications and Media Authority determines that paragraph 37EA(1)(a) of Schedule 4 applies to HDTV demonstration programs transmitted by specified commercial television broadcasting licensees during the specified period.   Note:  “HDTV demonstration program” is defined by subclause 37EA(10) of Schedule 4 to the Broadcasting Services Act 1992 as follows: HDTV demonstration program means a television program that is: (a)            not longer than 60 minutes; and (b)            transmitted in HDTV digital mode on the HDTV version of a commercial television broadcasting service; and (c)            produced for the sole purpose of allowing the benefits of transmission in HDTV digital mode to be demonstrated to potential purchasers of equipment capable of receiving television programs in HDTV digital mode.       The Common Seal of the Australian Communications and Media Authority was affixed to this document in the presence of:         Lyn Maddock                                                  Chris Cheah Signature of Member                                        Signature of Member
