Approval of Care Recipients Amendment Principles 2005 (No. 1) Aged Care Act 1997

1              Name of Principles                 These Principles are the Approval of Care Recipients Amendment Principles 2005 (No. 1). 2              Commencement                 These Principles commence on the day that they are registered. 3              Amendment of Approval of Care Recipients Principles 1997                 Schedule 1 amends the Approval of Care Recipients Principles 1997.
Schedule 1        Amendments (section 3)    [1]           Section 5.3, heading substitute 5.3           Definitions [2]           Section 5.3, after definition of Act insert in-patient hospital episode has the meaning given by section 15.3 of the Flexible Care Subsidy Principles 1997. transition care has the meaning given by section 15.28 of the Flexible Care Subsidy Principles 1997. [3]           After section 5.7 insert 5.7A        Flexible care — transition care                 A person is eligible to receive flexible care in the form of transition care only if the person:                 (a)    is assessed under section 22-4 of the Act as satisfying the following requirements:                           (i)    the person is in the concluding stage of an in-patient hospital episode;                          (ii)    the person is medically stable;                          (iii)    the person has the potential to benefit from transition care; and                (b)    is in hospital at the time the assessment is undertaken; and                 (c)    would be assessed, if the person applied for residential care, as eligible to receive residential care at least at the low level of care. [4]           Section 5.12 substitute 5.12        Purpose of Part (Act s 23-3)                 This Part specifies, in relation to residential care, respite care provided as residential care, and flexible care in the form of transition care:                 (a)    the entry period; and                (b)    the circumstances under which a person’s approval as a recipient lapses.
[5]           Section 5.13 substitute 5.13        Entry period                 The entry period, in relation to care of a kind mentioned in section 5.12, is one of the following periods:                 (a)    for residential care, or respite care provided as residential care — 12 months beginning on the day after the approval is given under subsection 22-1 (2) of the Act;                (b)    for flexible care in the form of transition care — 4 weeks beginning on the day after the approval is given under subsection 22-1 (2) of the Act. [6]           Subsection 5.14 (1) substitute          (1)   An approval lapses if the person in respect of whom the approval is given is not provided, for a period of at least 1 day after the entry period ends, with the care to which that approval relates.
