VARIATION TO LICENCE AREA PLAN FOR WAGGA WAGGA RADIO – No 1 of 2005 Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Broadcasting Authority varies the licence area plan for Wagga Wagga Radio determined on 6 December 2001 (the principal instrument) in the manner set out below: (1) The determination in the principal instrument is varied: (a) to number each of the paragraphs in the determination as clauses (1), (2), (3) and (4); and (b) in clause (2): (i) to delete the words “eleven national radio broadcasting services and two commercial radio broadcasting services” and to substitute the words “twelve national radio broadcasting services, two commercial radio broadcasting services and one open narrowcasting radio service’’; and (ii) to delete the numbers “1.2 – 1.15” in clause (2) and to substitute the numbers “1.2 - 1.19”; and (c) in clause (3), to delete the numbers “2.2 - 2.3” in of clause (3) and to substitute the numbers “2.2 – 2.4”; and (d) to insert the following clause after clause (4): “(5) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time”. (2) The schedules to the principal instrument are varied: (a) to delete Schedule One to the principal instrument and to substitute the table headed “Schedule One” in item 2 on page 5 of this instrument; and (b) to delete Schedule Two to the principal instrument and to substitute the table headed “Schedule Two” in item 3 on page 6 of this instrument; and (c) to delete Schedule Three to the principal instrument and to substitute the table headed “Schedule Three” in item 4 on page 7 of this instrument. (3) The attachments to the principal instrument are varied: (a) to insert Attachments 1.16, 1.17, 1.18 and 1.19 of this instrument after Attachment 1.15 of the principal instrument; and (b) to insert Attachment 2.4 of this instrument after Attachment 2.3 of the principal instrument; and (c) to delete Attachment 3.2 of the principal instrument and to substitute Attachment 3.2 of this instrument; and (e) to delete Attachment 1.1 of the principal instrument and to substitute Attachment 1.1 of this instrument; and (f) to delete Attachment 2.1 of the principal instrument and to substitute Attachment 2.1 of this instrument; and (g) to delete Attachment 3.1 of the principal instrument and to substitute Attachment 3.1 of this instrument.
