1 Name of Determination This Determination is the Hearing Services (Eligible Persons) Amendment Determination 2006 (No. 1). 2 Commencement This Determination commences on the day after it is registered. 3 Amendment of Hearing Services (Eligible Persons) Determination 1997 Schedule 1 amends the Hearing Services (Eligible Persons) Determination 1997.
Schedule 1 Amendments (section 3) [1] Section 3, after definition of Act insert de facto spouse means a person who is living with another person of the opposite sex on a bona fide domestic basis although not legally married to that other person. dependant, of an eligible person mentioned in paragraph 5 (2) (a), (b), (c) or (d) of the Act, means: (a) a person who has attained the age of 21 years and is the spouse or de facto spouse of the eligible person; or (b) a person who: (i) has attained the age of 21 years but is under 25 years; and (ii) is receiving full time education at a school, college or university; and (iii) is not being paid a disability support pension under the Social Security Act 1991; and (iv) is wholly or substantially dependent on the eligible person or the spouse or de facto spouse of the eligible person. [2] Subsection 4 (1) omit (3) or (4) insert (3), (4) or (5) [3] After subsection 4 (4) insert (5) The class consists of persons each of whom is: (a) an Australian citizen or Australian permanent resident; and (b) a dependant of an eligible person mentioned in paragraph 5 (2) (a), (b), (c) or (d) of the Act.
