I, BRUCE ROBERT GEMMELL, Acting Director of Aviation Safety, on behalf of CASA, make this instrument under subregulation 308 (1) of the Civil Aviation Regulations 1988 (CAR 1988) and paragraph 1.2 of Civil Aviation Order 100.5 (CAO 100.5).

Exemption — time-in-service recording on maintenance release
Determination — non-application of part of Civil Aviation Order 100.5
1          Duration
            This instrument:
(a)   commences on 1 August 2006; and
(b)   stops having effect at the end of 30 June 2008.
2          Application
            This instrument applies to:
(a)   Class A aircraft (the aircraft); and
(b)   the owner, the operator and the pilot in command of a Class A aircraft (the relevant persons).
3          Exemption
            Each aircraft and each relevant person is exempt from compliance with regulation 43B of CAR 1988.
4          Conditions
             The exemption is subject to the conditions mentioned in Schedule 1.
5          Determination
            Subparagraphs 6.5 (d), (e) and (f) of CAO 100.5 do not apply to Class A aircraft.
Schedule 1          Conditions
             The operator of the aircraft:
(a)   must ensure that the aircraft’s approved system of maintenance includes an approved recording method for time-in-service which is sufficient to meet continuing airworthiness requirements; and
(b)   must include details of the recording method in the operator’s maintenance control manual prepared for regulation 42ZY of CAR 1988.
