1              Name of Standard
                This Standard is the Radiocommunications (Digital Cordless Communications Devices — DECT Devices) Standard 2007.
2              Commencement
                This Standard commences on the day after it is registered.
3              Definitions
                In this Standard:
ACA TS 028 – 1997 means the Telecommunications Technical Standard (Radio Equipment and Systems for DECT — ACA TS 028 – 1997).
Act means the Radiocommunications Act 1992.
DECT means Digital Enhanced Cordless Telecommunications.
digital cordless communications device means a radiocommunications device using DECT technology, excluding DECT devices that are designed or intended to operate within one or more of the following frequency bands:
                (a)    915‑928 MHz;
               (b)    2400‑2483.5 MHz;
                (c)    5725‑5850 MHz.
Note   A DECT device designed or intended to operate within one or more of the above frequency bands may be required to comply with the Radiocommunications (Short Range Devices) Standard 2004.
EIRP means equivalent isotropically radiated power.
ETSI EN 301 406 means the ETSI standard, “ETSI EN 301 406 Digital Enhanced Cordless Telecommunications (DECT); Harmonised EN for Digital Enhanced Cordless Telecommunications (DECT) covering essential requirements under Article 3.2 of the R&TTE Directive; Generic radio”, as in force from time to time.
significant event means an event at a specified location or locations, notified on the website http://www.acma.gov.au with the approval of the Chairman of ACMA.
Note   Section 7 of the Act contains the definition of radiocommunications device.
4              Application
         (1)   This Standard applies to a digital cordless communications device other than a device imported into, and used in, Australia in the circumstances in subsection (2).
         (2)   This Standard does not apply to a digital cordless communications device if:
                (a)    the device is imported solely for use in connection with a significant event; and
               (b)    if required to be tested or inspected by ACMA before it is used in Australia — the device meets the testing or inspection requirements; and
                (c)    if conditions or requirements are imposed by ACMA on the use of the device in Australia — the device meets those conditions or requirements; and
               (d)    the device is used in Australia only:
                          (i)    at the location of the significant event; and
                         (ii)    for the duration of the significant event.
5              Standard for performance
                For paragraph 162 (1) (a) of the Act, the standard for performance of a digital cordless communications device is the standard set out in ETSI EN 301 406, modified so that the device must operate:
                (a)    only on frequencies between 1880 and 1900 MHz; and
               (b)    with a radiated power of no more than 36 dBm EIRP.
6              Compliance with this Standard — devices complying with ACA TS 028 – 1997
                If a particular model of a digital cordless communications device complied with ACA TS 028 – 1997 before the commencement of this Standard, any digital cordless communications device of that model is taken to comply with this Standard regardless of when the device was manufactured, imported, altered or modified.
7              Effect of amendment of standard for performance
         (1)   This section applies to a digital cordless communications device (other than a device mentioned in section 6) if the standard for performance described in section 5 is amended.
         (2)   A digital cordless communications device that is manufactured, imported, altered or modified within 1 year after the date of effect of the amendment (the amendment date) is taken to comply with the standard for performance, as amended, if the device complies with that standard as in force immediately before the amendment date.
         (3)   A digital cordless communications device that is manufactured, imported, altered or modified 1 year or more after the amendment date must comply with the standard for performance, as amended.
