Determination 2007/03:
Remuneration and Allowances for Holders of Public Office and Members of Parliament
 
(i)        Pursuant to subsections 7(1), 7(3) and 7(4) of the Remuneration Tribunal Act 1973, the Remuneration Tribunal has inquired into the remuneration and allowances to be paid to holders of public office, and other matters significantly related thereto, and determines as set out below.
 
(ii)        This Determination takes effect on and from the day following the day it is registered in the Federal Register of Legislative Instruments unless otherwise specified.
 
PART 1 – PART-TIME OFFICES
 
1.1       In this part, Determination Number 12 of 2006 (as amended) is referred to as the Principal Determination.
 
1.2       Table A1A of Schedule A of the Principal Determination is amended by deleting the entries for the “Australian Institute of Family Studies – Board of Management”, “Award Review Taskforce”, “Copyright Law Review Committee”, “National Procurement Board”, “Nursing Homes Fees Review Committees of Enquiry” and “Stevedoring Industry Finance Committee”.
 
1.3       Table A1A of Schedule A of the Principal Determination is amended by replacing the entry for “Australian Heritage Council – Co-opted Commissioner” with the following entry:

1.11     The Principal Determination is amended by including Clause A41 in the Additional Clauses to Table A1A as follows:
“A41. Tax Agents’ Board:  For the Chairman and Members of the Tax Agents’ Board, in lieu of clause 2.8(a), individual periods of business must be on other than formal meeting days and each period must be for a minimum of six minutes.
 
1.12     Clauses 1.10 to 1.11 take effect on and from 15 May 2007.
 
1.13     Table A1A of Schedule A of the Principal Determination is amended by replacing the entry for “Tourism Australia” with the following entry:

PART 2 – FULL-TIME OFFICES
 
2.1                 In this part, Determination Number 13 of 2006 (as amended) is referred to as the Principal Determination.
 
2.2                 Table 3A – Accommodation Allowances of the Principal Determination is amended by removing the entry for Ms P Goward, Sex Discrimination Commissioner.
 
2.3                 Tables 3A - Accommodation Allowances and 3B – Reunion Travel of the Principal Determination are amended by removing the entries for Mr Jeffrey Lucy, Chairman ASIC.
 
2.4         Part 3 of the Principal Determination is amended by deleting Clause 3.2.1.
 
2.5         Clauses 2.3 to 2.4 take effect on and from 13 May 2007.
 
PART 3 – MEMBERS OF PARLIAMENT
 
3.1                 In this part, Determination Number 18 of 2006 (as amended) is referred to as the Principal Determination.
 
3.2                 Clauses 8.7 to 8.8 are amended by replacing the current entry with the following:
 
8.7      Senators and members eligible for the Resettlement Allowance are those who:
 
(a)      have joined the Parliament at or since the November 2001 election; and
 
(b)      are not able to access a pension or superannuation benefit (related to their service in the Parliament) immediately upon ceasing to be a Member of the Parliament; and
 
(c)      have retired involuntarily through:
 
(i)                 electing not to stand for re-election following loss of party endorsement, for reasons other than misconduct; or
 
(ii)               defeat at an election (including defeat at an election where he or she has campaigned to be elected to represent a different electoral division or to the other House of the Parliament).
 
8.8      The Resettlement Allowance will be payable:
 
(a)      only after the senator or member ceases to be a senator or member; and
 
(b)      at the rate of basic parliamentary salary that is current on the date the Parliament is prorogued prior to the election.
