Enabling legislation
 
1.       The Australian Securities and Investments Commission makes this instrument under paragraph 601QA(1)(b) of the Corporations Act 2001.
Title
 
2.       This instrument is ASIC Class Order [CO 07/166].
Commencement
 
3.         This instrument commences:
(a)        immediately after the commencement of ASIC Class Order           [CO 07/88]; or
(b)        the date this instrument is registered under the Legislative Instruments Act 2003,
whichever is later.
Note:        An instrument is registered when it is recorded on the Federal Register of Legislative Instruments (the FRLI) in electronic form: see the Legislative Instruments Act 2003, s 4 (definition of register).  The FRLI may be accessed at http://www.frli.gov.au/.
Variation
 
4.         ASIC Class Order [CO 02/315] is varied by, in paragraph 2, inserting after notional paragraph 601GA(1A)(f):
 
“(fa)     the operator must keep a written record in relation to a cooling-off statement referred to in paragraph (f) for 7 years after the relevant cooling-off statement is issued;”.
