1           Name of Standard
                This Standard is the Radiocommunications (Cordless Telephone) Standard 2008.
2           Commencement
                This Standard commences on the day after it is registered.
3           Definitions
         (1)   In this Standard:
Act means the Radiocommunications Act 1992.
AS/NZS 4281:2007 means the Australian/New Zealand Standard titled AS/NZS 4281:2007 Radiocommunications requirements for cordless telephones operating in the 1.7 MHz and between 30 and 41 MHz frequency bands.
AS/NZS CISPR 22:2006 means the Australian/New Zealand Standard titled AS/NZS CISPR 22:2006 Information technology equipment ‑ Radio disturbance characteristics ‑ Limits and methods of measurement.
cordless telephone means a radiocommunications device that is capable of forming part of a cordless telephone service, within the meaning of the Radiocommunications (Interpretation) Determination 2000, that operates on the frequency 137 MHz or a frequency less than 137 MHz.
cordless telephone frequency band means any of the following frequency bands:
                (a)    1.7175 MHz to 1.7925 MHz;
               (b)    30.0625 MHz to 30.3125 MHz;
                (c)    39.7625 MHz to 40.250 MHz.
model, in relation to a cordless telephone, means a version of the cordless telephone that has a particular design and identifying number.
significant event means an event at a specified location or locations, notified, with the approval of the Chairman of ACMA, on the website:

         (2)   In this Standard, a reference to an Australian/New Zealand Standard is a reference to that standard as in force when this Standard takes effect.
4           Revocation of Radiocommunications Standard (Cordless Telephone) No. 1 of 1997
                The Radiocommunications Standard (Cordless Telephone) No. 1 of 1997 is revoked.
5           Application
         (1)   This Standard applies to a radiocommunications device:
                (a)    that is a cordless telephone; and
               (b)    that is not a device mentioned in subsection (2).
Exception — device imported for significant event
         (2)   This subsection applies to a radiocommunications device that:
                (a)    is imported in Australia solely for use in connection with a significant event; and
               (b)    if required to be tested or inspected by ACMA before it is used in Australia — meets the testing or inspection requirements; and
                (c)    if conditions or requirements are imposed by ACMA on the use of the device in Australia — complies with those conditions or requirements; and
               (d)    is used in Australia only at the location of the significant event; and
                (e)    is used in Australia only for the duration of the significant event.
6           Standard for performance — cordless telephone
         (1)   For paragraph 162 (1) (a) of the Act, a cordless telephone must not be capable of being operated, by itself or as part of a cordless telephone service, in a frequency band other than:
                (a)    in a cordless telephone frequency band; or
               (b)    in the range of frequencies mentioned in column 3 of the Schedule to the Radiocommunications (Low Interference Potential Devices) Class Licence 2000.
         (2)   For paragraph 162 (1) (a) of the Act, the standard for the performance of a cordless telephone that is capable of being operated in a cordless telephone frequency band is:
                (a)    the standard set out in AS/NZS 4281:2007, other than:
                          (i)    clause 1 of the standard (“Scope”); and
                         (ii)    paragraph 5.4 (“Equipment markings”);
                        to the extent to which AS/NZS 4281:2007 sets out requirements applicable in Australia; and
               (b)  the standard set out in those provisions of Australian/New Zealand Standard AS/NZS CISPR 22:2006 that are adopted or applied by Australian/New Zealand Standard AS/NZS 4281:2007.
Note   Cordless telephones may be subject to requirements specified in standards under the Telecommunications Act 1991 or in class licences made under the Radiocommunications Act 1992.
7           Compliance with this Standard — devices complying with former Standard
         (1)   Subsection (2) applies despite the revocation of the Radiocommunications Standard (Cordless Telephone) No. 1 of 1997 (the former Standard).
         (2)   If a particular model of cordless telephone complied with the former Standard before the commencement of this Standard, any cordless telephone of that model is taken to comply with this Standard, regardless of when the cordless telephone was manufactured, imported, altered or modified.
8           Compliance with this Standard after amendment of the standard for performance
         (1)   Subsections (2) and (3) apply to cordless telephones (other than cordless telephones to which subsection 7 (2) applies) if the standard for performance described in subsection 6 (2) is amended.
         (2)   Cordless telephones that are manufactured, imported, altered or modified within 1 year after the date of effect of the amendment (the amendment date) are taken to comply with the standard for performance, as amended, if the equipment complies with that standard as in force immediately before the amendment date.
         (3)   Cordless telephones that are manufactured, imported, altered or modified 1 year or more after the amendment date must comply with the standard for performance as amended.
