In accordance with subsection 425 (1AA) of the Navigation Act 1912, I make this Order amending Marine Orders Part 63, Issue 1, and to come into operation on 20 December 2008.

IMO means the International Maritime Organization;
penal provision means a penal provision for the purposes of regulation 4 of the Navigation (Orders) Regulations 1980;
Note   Subregulation 4 (1) of the Navigation (Orders) Regulations 1980 provides that a person commits an offence if the person does not comply with a provision of an order made under subsection 425 (1AA) of the Navigation Act that is expressed to be a penal provision.  A person who is found guilty of such an offence is punishable by a fine not exceeding 50 penalty units, and a body corporate is punishable by a fine not exceeding 250 penalty units.  Section 4AA of the Crimes Act 1914 provides that a penalty unit is equivalent to $110.

3      Interpretation
            In this Part:
(a)     headings and subheadings are part of the Part; and
(b)     each Appendix is part of the Part; and
(c)     a note is not part of the Part, but may provide additional information or guidance in applying the Part.
4      Application
            This Part applies to the following ships while in the AUSREP area:
(a)     an Australian ship;
(b)     a ship (other than an Australian ship) from its arrival at its first port in Australia until its departure from its final port in Australia.
Note 1   For Division 14 of Part IV of the Navigation Act, an ‘Australian ship’ is defined, in section 269B of the Act, to mean a ship to which Part II of the Navigation Act applies.
Note 2   The AUSREP system is designed to assist AMSA carry out its functions in a search and rescue situation.  For this reason, all commercial ships are encouraged to participate in it whenever they are in the AUSREP area, even when it is not mandatory for them to do so.

6.1       Subject to provision 6.2, the master of a ship that is in the AUSREP area must make, or arrange to make, the following reports to the Rescue Coordination Centre (RCC) Australia using the transmission method mentioned in the relevant clause:
(a)     a Sailing Plan in accordance with clause 1 of Appendix 1;
(b)     1 or more Position Reports in accordance with clause 2 of Appendix 1;
(c)     a Deviation Report (if applicable) in accordance with clause 3 of Appendix 1;
(d)     a Final Report in accordance with clause 4 of Appendix 1.

2.1.2    If:
(a)     Inmarsat-C polling cannot be used to obtain the position of a ship, the master of the ship must report the ship’s position using Inmarsat-C or HF DSC; or
(b)     RCC Australia directs the master to report the position of a ship, the master must report the ship’s position using one of the following methods, in order of RCC Australia’s preference of receiving the report:
(i)         Inmarsat-C;
(ii)        HF DSC;
(iii)       another Inmarsat telephone or fax service;
(iv)       another suitable transmission method.

2.2      When Position Report must be submitted, if not polled
            If the master of a ship uses Inmarsat-C or HF DSC to report the ship’s position, the master must submit the report to AMSA once every 24 hours between the hours of 2200 UTC and 0800 UTC.
Note   Ships participating in AUSREP through Inmarsat-C polling will be polled by AMSA at least once every 24 hours or at an interval considered appropriate by AMSA.
2.3      Information to be provided in Position Report
            A Position Report must:
(a)     insert the code ‘AUSREP/PR//’ in the first line of text; and
(b)     using the message format field identifier mentioned in column 2 of items 1 to 6 of the following table, set out the information mentioned in column 3 of those items in the order mentioned in the table; and
(c)     using the message format field identifier mentioned in column 2 of items 7 and 8 of the following table, set out the information mentioned in column 3 of whichever of those items is applicable to the Report in the order mentioned in the table.
