VARIATION TO LICENCE AREA PLAN FOR RIVERLAND (TELEVISION AND RADIO) – No 1 of 2008
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992, the Australian Communications and Media Authority varies the Licence Area Plan for Riverland (Television and Radio) determined on 22 August 1996 (the principal instrument) in the manner set out below:
1) The determination in the principal instrument is varied to:
a) number each of the paragraphs in the determination consecutively as clauses (1), (2), (3) and (4);
b) in clause (2) to:
i) omit the words “One national or community television broadcasting service”;
ii) omit the word “two” and substitute the word “Two”;
iii) omit the words “one commercial television broadcasting service” and substitute the words “two commercial television broadcasting services”;
iv) omit the words “1.2 – 1.19” and substitute the words “1.2, 1.3, 1.6, 1.8 – 1.10, 1.15 and 1.17 – 1.23”;
c) in clause (3) to:
i) omit the word “Four” and substitute the word “Five”;
ii) omit the words “two commercial radio broadcasting services and two open narrowcasting radio broadcasting services” and substitute the words “two commercial radio broadcasting services, two open narrowcasting radio broadcasting services and one community radio broadcasting service”;
iii) omit the words “2.2 – 2.10” and substitute “2.2 – 2.13”;
d) omit clause (4);
e) insert the following clause after clause (3):
“(4) A reference in this determination to a schedule or an attachment includes a reference to a schedule or attachment as amended from time to time.”
2) Immediately following the determination:
a) omit the heading “SCHEDULES”;
b) omit the words “Each of the schedules set out:”; and
c) omit all six paragraphs marked with dot points.
3) The schedules to the principal instrument are varied to:
a) omit Schedule One, Schedule Two and Schedule Three of the principal instrument and substitute Schedule One and Schedule Two of this instrument.
4) Attachments to the principal instrument are varied to:
a) omit Attachment 1.1 of the principal instrument and substitute Attachment 1.1 of this instrument;
b) omit Attachment 1.2 of the principal instrument and substitute Attachment 1.2 of this instrument;
c) omit Attachments 1.4 and 1.5 of the principal instrument;
d) omit Attachment 1.7 of the principal instrument;
e) omit Attachment 1.9 of the principal instrument and substitute Attachment 1.9 of this instrument;
f) omit Attachment 1.10 of the principal instrument and substitute Attachment 1.10 of this instrument;
g) omit Attachments 1.11, 1.12, 1.13 and 1.14 of the principal instrument;
h) omit Attachment 1.15 of the principal instrument and substitute Attachment 1.15 of this instrument;
i) omit Attachment 1.17 of the principal instrument and substitute Attachment 1.17 of this instrument;
j) omit Attachment 1.18 of the principal instrument and substitute Attachment 1.18 of this instrument;
k) omit Attachment 1.19 of the principal instrument and substitute Attachment 1.19, 1.20, 1.21, 1.22 and 1.23 of this instrument;
l) omit Attachment 2.1 from the principal instrument and insert Attachment 2.1 of this instrument;
m) insert Attachments 2.11, 2.12 and 2.13 of this instrument after Attachment 2.10 of the principal instrument; and
n) omit Attachments 3.1, 3.2 and 3.3 from the principal instrument
Commencement
5) This instrument commences on 1 August 2008.
