Variation to Licence Area Plan for Lithgow Radio – No. 1 of 2008
Pursuant to subsection 26(2) of the Broadcasting Services Act 1992 (the BSA), the Australian Communications and Media Authority varies the Licence Area Plan for Lithgow Radio determined on 14 May 1997 (the principal instrument) in the manner set out below:
(1) The determination in the principal instrument is varied to:
(a) number each of the paragraphs in the determination consecutively as clauses (1), (2) and (3);
(b) in paragraph (1) of the determination:
(i) delete the words “Four national radio broadcasting services” and substitute the words “Seven national radio broadcasting services”;
(ii) delete the words and numbers “Attachments 1.2-1.8” and substitute the words and numbers “Attachments 1.2-1.13”
(c) insert the following clauses after clause (3):
“(4) A reference in this determination to a schedule or an attachment includes a reference to a schedule as amended from time to time.”
(2) Immediately following the determination, the principal instrument is varied to:
(a) omit the heading ‘Schedules’; and
(b) omit the words “The Schedule sets out:”; and
(c) omit all six paragraphs marked with dot points.
(3) Schedules to the principle instrument are varied to:
(a) omit Schedule One of the principal instrument and substitute Schedule One of this instrument; and
(b) omit Schedule Three of the principal instrument.
(4) Attachments to the principal instrument are varied to:
(a) omit Attachment 1.1 of the principal instrument and substitute Attachment 1.1 of this instrument; and
(b) omit attachments 1.2; 1.3 and 1.3.1 of the licence area plan;
(c) omit the heading “Attachment 1.2.1” from Attachment 1.2.1 and substitute the heading 1.2;
(d) insert Attachments 1.3,1.9, 1.10, 1.11 and 1.13 of this instrument in the principal instrument in numerical order;.
(e) omit Attachments 3.1, 3.2 and 3.4 of the principal instrument;
(f) omit the heading “Attachment 3.3” from Attachment 3.3 and substitute the heading 1.12 and insert the attachment after Attachment 1.11; and
(g) omit Attachment 2.1 of the principal instrument and substitute Attachment 2.1 of this instrument.
