Amendment Statement of Principles
concerning
 
SOFT TISSUE SARCOMA
No. 36 of 2008
 
for the purposes of the
 
Veterans’ Entitlements Act 1986
and
Military Rehabilitation and Compensation Act 2004
 
1.                      This Instrument may be cited as Statement of Principles concerning soft tissue sarcoma No. 36 of 2008.
 
2.                      The Repatriation Medical Authority amends, under subsection 196B(8) of the Veterans’ Entitlements Act 1986, Statement of Principles concerning soft tissue sarcoma No. 14 of 2006 by:
 
A.                 Replacing the existing factor (i) in clause 6 with the following:
 
"(i)      for uterine sarcoma only,
                                                                      (i)            undergoing treatment with tamoxifen for a period of at least four months before the clinical onset of soft tissue sarcoma; or
                                                                    (ii)            being obese for a period of at least ten years within the twenty years before the clinical onset of soft tissue sarcoma; or"; and
 
B.                 Inserting the following definition of "being obese" in clause 9;
'"being obese" means an increase in body weight by way of fat accumulation which results in a Body Mass Index (BMI) of thirty or greater.
The BMI = W/H2 and where:
W is the person’s weight in kilograms and
H is the person’s height in metres;'.
 
 
3.                      The amendment made by this instrument applies to all matters to which Instrument No. 14 of 2006, section 120B of the Veterans’ Entitlements Act 1986 and section 339 of the Military Rehabilitation and Compensation Act 2004 apply.
 
4.                      The amendment made by this instrument takes effect from 30 April 2008.
