INSTRUMENT OF AUTHORISATION
(SUBSECTION 27(5))
 
 
I, CHRIS EVANS, Minister for Immigration and Citizenship, acting under subsection 27(5) of the Australian Citizenship Act 2007 (‘the Act’):
 
REVOKE Instrument IMMI 09/026, signed on 11 May 2009 authorising classes of persons, and the persons from time to time holding, occupying or performing the duties of a position, for the purposes of subsection 27(5) of the Act; AND
 
AUTHORISE the classes of persons, and the persons from time to time holding, occupying or performing the duties of, a position mentioned in the Schedule to this Instrument, to receive a pledge of commitment.
 
 
This Instrument, IMMI 09/087, commences on the day after registration on the Federal Register of Legislative Instruments.

[NOTE:        Subsection 27(5) of the Act provides that the Minister may, by legislative instrument, authorise a class of persons before whom a pledge of commitment must be made.]
SCHEDULE
 
Classes of persons authorised to receive pledge of commitment under subsection 27(5)
 
 
1.         State, Territory, Regional and Area Offices:
 
A person who:
 
(a)        is an Australian citizen; and
(b)        is performing duties under or for the purposes of the Act; and
(c)        is for the time being the holder of, or is performing the duties of, a position in a State, Territory, Regional or Area Office of the Department of Immigration and Citizenship being a position classified:
(i)           as a Senior Executive Service position; or
(ii)         at the level of Executive Levels 1 or 2; or
(iii)        at the level of Australian Public Service Levels 4, 5 or 6.
 
 
2.         Overseas:
 
A person who:
 
(a)        is an Australian citizen; and
(b)        is outside Australia; and
(c)        is for the time being the holder of, or is performing the duties of, a position in the Department of Immigration and Citizenship being a position classified:
(i)           as a Senior Executive Service position; or
(ii)         at the level of Executive Levels 1 and 2; or  
(iii)        at the level of Australian Public Service Level 6.
 
 
3.           A person who is an Australian citizen and who is for the time being the holder of, or performing the duties of, any of the following offices:
 
 
(a)               Australian diplomatic, consular and trade representatives:
 
(i)      High Commissioner;
(ii)     Ambassador;
(iii)     Minister;
(iv)    Chargé d'Affaires;
(v)     Chargé d'Affaires ad interim;
(vi)    Deputy High Commissioner;
(vii)    Consul General;
(viii)   Consul, at a post at which he or she is the senior Australian diplomatic representative;
(ix)    Trade Commissioner at a post where there is no representative from the Department of Foreign Affairs and Trade or from the Department of Immigration and Citizenship.
 
(b)               offices in the Australian Capital Territory:
 
(i)            Members of the Legislative Assembly;
(ii)           Director, ACT Office of Multicultural, Aboriginal and Torres Strait Islander Affairs.
 
 
(c)                offices in New South Wales:
 
(i)            Lord Mayor of a city;
(ii)           Mayor of a city, municipality or town;
(iii)         Deputy Mayor of a city, municipality or town;
(iv)         Deputy Lord Mayor, City of Sydney Council;
(v)          General Manager of a council;
(vi)         Administrator of a council in cases where a council has been placed under Administration.
 
 
(d)               offices in the Northern Territory:
 
(i)      Lord Mayor of a city;
      (ii)     Mayor of a city, municipality or town;
(iii)         Deputy Mayor or Deputy Principal Member of a city, municipality or town;
(iv)         Principal Member of a city, municipality or town;
(v)          Chief Executive Officer, Town Clerk or Council Clerk of a city, municipality or town;
(vi)         President or Mayor of a Shire Council;
(vii)       Administrator of the Northern Territory;
(viii)      Chair of the Nhulunbuy Town Board;
(ix)         Sub-Collector of Customs, Groote Eylandt;
(x)          Customs Officer resident on Groote Eylandt.
 
                                      
(e)               offices in Queensland
 
(i)            Lord Mayor of a city;
(ii)           Mayor of a region, city, town or shire council;
(iii)         Deputy Mayor of a region, city, town or shire council;
(iv)         Chief Executive Officer of a local government;
(v)          Councillor of the Brisbane City Council;
(vi)         Administrator of a council in cases where a council has been placed under Administration;
(vii)       Councillors in Torres Strait Island Regional Council;
(viii)      A person who holds, or is performing the duties of, either of the following positions in Commonwealth Aluminium Corporation Pty Ltd at Weipa:
(a)           General Manager of Operations;
(b)          Town Manager.
 
 
 
(f)                 offices in South Australia
 
(i)      Lord Mayor of a city;
(ii)     Mayor or Chairperson of a council (with the exception of Councillor Peter Davis, the Mayor of Port Lincoln);
(iii)     Deputy Mayor or Deputy Chairperson of a council;
(iv)    Administrator of a municipality or council in cases where a municipality or council has been placed under Administration;
(v)     President of the Andamooka Progress and Opal Miners’ Association;
(vi)    Secretary, Woomera Board;
(vii)    Chief Executive Officer of a council.
 
 
(g)               offices in Tasmania:
 
(i)      Lord Mayor of a city;
(ii)     Mayor of a council;
(iii)    Deputy Mayor of a council;
(iv)    Council’s Manager Media & Community Relations, Launceston City Council;
(v)     Corporate Secretary, Launceston City Council;
(vi)    General Manager of a council;
(vii)   Administrator of a council in cases where a council has been placed under Administration.
 
 
(h)        offices in Victoria:
 
(i)      Lord Mayor of Melbourne City Council;
(ii)     Mayor of a municipal council;
(iii)     holder of the office commonly accepted to be Deputy Mayor of a municipal council;
(iv)         Chief Executive Officer of a municipal council;
(v)          General Manager of a municipal council;
(vi)    Governor in Council appointed Administrator of a municipal council;
(vii)    Councillor, Robinvale Ward, Swan Hill Rural City Council.
 
 
(i)         offices in Western Australia:
 
(i)       Lord Mayor of a city;
(ii)     Mayor of a city, municipality or town;
(iii)     Deputy Mayor or Deputy President of a city, municipality or town;
(iv)    Chief Executive Officer of a city, municipality or town;
(v)     President of a shire council;
(vi)    Chairman of Commissioners in cases where a council has been placed under Administration;
(vii)       Councillor, Coastal Ward, Shire of Coorow;
(viii)      Councillor, Shire of East Pilbara;
(ix)         Councillors, Leinster Ward, Shire of Leonora;
(x)                Councillor of the Town of Fitzroy Crossing, Shire of Derby/West Kimberley;
(xi)            Councillor of the Town of Kununurra, Shire of Wyndham/East Kimberley;
(xii)             Councillors, Shire of Ashburton;
(xiii)           Councillor of the Shire of Moora.
 
 
(j)         offices in Australian external territories:
 
(i)            Station Leader, Australian Antarctic Base, Casey;
(ii)           Station Leader, Australian Antarctic Base, Davis;
(iii)         Station Leader, Australian Antarctic Base, Mawson;
(iv)         President, Shire of Christmas Island;       
(v)          Chief Executive Officer, Shire of Cocos (Keeling) Islands;
(vi)         President, Shire of Cocos (Keeling) Islands;
(vii)       Administrator, Norfolk Island;
(viii)      Vice Chairman, Lord Howe Island Board.
