1              Name of Determination
                This Determination is the Health Insurance (Diagnostic Imaging Accreditation - Approved Accreditors) Determination 2009.
2              Purpose of Determination
                The purpose of this Determination is to approve accreditors who are to receive and make decisions regarding accreditation on applications by *proprietors of *diagnostic imaging practices seeking *actual accreditation of their practices in accordance with the Health Insurance (Diagnostic Imaging Accreditation) Determination 2008. 
3              Commencement and Revocation
1)      This Determination is to commence on the day after registration.
2)      This Determination revokes the Health Insurance (Diagnostic Imaging Accreditation - Approved Accreditors) Determination 2008 made on 9 May 2008.
Note   The reference to registration in section 3 relates to the registration of this Determination in the Federal Register of Legislative Instruments - see Division 2 of Part 4 of the Legislative Instruments Act 2003.
4              Cessation
                This Determination will cease to have effect at the end of 30 June 2010.
5              Interpretation
         (1)   In this Determination:
Act means the Health Insurance Act 1973.
actual accreditation refers to accreditation of a *diagnostic imaging practice based on its compliance with criteria established in a legislative instrument establishing a diagnostic imaging accreditation scheme under paragraph 23DZZIAA(1)(a) of the *Act, being the Health Insurance (Diagnostic Imaging Accreditation) Determination 2008.  *Actual accreditation is distinguished from *deemed accreditation for which *item 12 provides.
diagnostic imaging practice means *diagnostic imaging premises or a *base for mobile diagnostic imaging equipment.
(2)  A reference in this Determination to item 12 means item 12 of Schedule 1 of the Act and a reference to a subitem has a corresponding meaning.
(3)  A term used in a provision in this Determination that is defined in this section or in the *Act is shown with an asterisk.
Note 1   Unless a contrary intention appears, an expression used in this Determination has the same meaning as in the Act — see section 13 of the Legislative Instruments Act 2003.
Note 2   Terms defined in subsection 3(1) of the *Act and which are used in this Determination include approved accreditor, base for mobile diagnostic imaging equipment, diagnostic imaging premises, and proprietor.
6              Approval of persons to accredit diagnostic imaging practices
         (1)   For the purposes of paragraph 23DZZIAA(1)(b) of the *Act and the Health Insurance (Diagnostic Imaging Accreditation) Determination 2008 the persons approved to accredit *diagnostic imaging practices (approved accreditors) are:
                (a)  Health and Disability Auditing Australia Pty Ltd (ACN 134 482 625);
                (b)  National Association of Testing Authorities, Australia (ACN 004 379 748);
                (c)  Quality in Practice Pty Ltd (ACN 094 965 590); and
                (d)  The Australian Council on Healthcare Standards Limited (ACN 008 549 773).
         (2)   The approvals of persons named in subsection (1) are effective from and including the day after the date of registration of this instrument until the end of the day on 30 June 2010.
