The AUSTRALIAN COMMUNICATIONS AND MEDIA AUTHORITY makes this Determination under subsection 38B (14) of the Broadcasting Services Act 1992.

1              Name of Determination
                This Determination is the Broadcasting Services (Amalgamated Remote Television Licence Areas – Remote Central and Eastern Australia TV1 and Mt Isa TV1) Determination 2009.
2              Commencement
                This Determination commences on the day after it is registered.
3              Definitions
                In this Determination:
ACMA means the Australian Communications and Media Authority.
Act means the Broadcasting Services Act 1992.
Licence Area Plan – Remote Central and Eastern Australia Television means the Licence Area Plan – Remote Central and Eastern Australia Television – December 1996, as varied by the following instruments:
(a)                                Licence Area Plan – Remote Central and Eastern Australia Television – Variation – December 1998;
(b)                               Licence Area Plan – Remote Central and Eastern Australia Television – Variation – March 2001; and
(c)                                Licence Area Plan – Remote Central & Eastern Australia Television – Variation – September 2004.
Mt Isa TV1 licence area has the same meaning as in the Licence Area Plan – Remote Central and Eastern Australia Television.
Remote Central and Eastern Australia TV1 licence area has the same meaning as in the Licence Area Plan – Remote Central and Eastern Australia Television.
remote licence area has the same meaning as in clause 2 of Schedule 4 to the Act.
4              Determination – paragraph 38B (14) (b) of the Act
Under paragraph 38B (14) (b) of the Act, ACMA determines that section 38B applies to the two licence areas specified in the Schedule to this Determination as if those two licence areas were one licence area.
 
Note 1: Both licence areas in the Schedule are remote licence areas. The licence area in column A of the Schedule is wholly within the licence area in column B of the Schedule.
 
Note 2:  Subsection 38B (14A) provides that, if a determination is made under paragraph 38B (14) (b) of the Act for remote licence areas, then section 38B applies as if the single licence area referred to in subsection 38B (14) were the licence area that is entirely within the other licence area.
