I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Renewable Energy (Electricity) Act 2000.

1              Name of Regulations
                These Regulations are the Renewable Energy (Electricity) Amendment Regulations 2010 (No. 9).
2              Commencement
                These Regulations commence on the commencement of Part 1 of Schedule 1 to the Renewable Energy (Electricity) Amendment Act 2010.
3              Amendment of Renewable Energy (Electricity) Regulations 2001
                Schedule 1 amends the Renewable Energy (Electricity) Regulations 2001.

Division 1              Large‑scale generation shortfall charge
[2]           Paragraph 23 (j)
substitute
                (j)    for 2010 — 5.98%; and
               (k)    for 2011 — 5.62%.

Division 2              Small‑scale generation shortfall charge
23A         Small‑scale technology percentage
                For subsection 40A (1) of the Act, the small‑scale technology percentage for 2011 is 14.80%.
