GEAR DETERMINATION No. NPFGD 05
 (revoking NPF Gear Determination No. 04)
 
I, Glenn Hurry, Chief Executive Officer of the Australian Fisheries Management Authority, as  delegate of powers conferred upon AFMA, make the following Determination under section 17(6)(aa) of the Fisheries Management Act 1991 and section 7A(1) of the Northern Prawn Fishery Management Plan 1995.

Citation
1.      This Determination may be cited as Gear Determination No. NPFGD 05.
Commencement and period of application
2.      This Direction commences the day after it is registered on the Federal Register of Legislative Instruments.
Interpretation
3.      A term used in this Determination that is defined for the purposes of the Northern Prawn Fishery Management Plan 1995 has the same meaning in this Determination as it has in that plan. If no meaning is given to the word in the Northern Prawn Fishery Management Plan 1995, takes the meaning given to that word under the Fisheries Management Act 1991.
‘Otter board’ means a board or plate used on a fishing net which, when the net is being towed, keeps the mouth of the net open.
‘Twin trawl net configuration’ means the use of two fishing nets designed or intended to be towed simultaneously by a boat and having the mouth or opening of each net being controlled by the use of otter boards.
‘Quad trawl net configuration’ means the use of four fishing nets designed or intended to be towed simultaneously by a boat and having the mouth or opening of each net being controlled by the use of otter boards.
‘Twin tongue trawl net configuration’ means the use of two fishing nets designed or intended to be towed simultaneously by a boat and having the mouth or opening of each net being controlled by otter boards and at least one bridle extending from each warp wire to the centre or ‘tongue’ of the headrope of each net.
Determination of fishing capacity
 
4.      The total length of operational headrope for a twin trawl net configuration that may be used under gear statutory fishing rights in the area of the Northern Prawn Fishery is 2951.45 metres. This equates to 8.319 cm per gear statutory fishing right.
5.      The total length of operational headrope for a quad trawl net configuration that may be used under gear statutory fishing rights in the area of the Northern Prawn Fishery is 2655.95 metres. This equates to 7.486 cm per gear statutory fishing right.
6.      The total length of operational headrope for a twin tongue trawl net configuration that may be used under gear statutory fishing rights in the area of the Northern Prawn Fishery is 2655.95 metres. This equates to 7.486 cm per gear statutory fishing right.
Revocation of Determination No NPFGD 04
 
7.      This Determination revokes NPFGD 04 with effect from the commencement date of this Determination.
