I GLENN HURRY, Chief Executive Officer and delegate of The Australian Fisheries Management Authority make this order under subsection 43(2) of the Fisheries Management Act 1991 (the Fisheries Management Act), being satisfied that:
(a)     it is necessary to take action under s43 of the Fisheries Management Act;
(b)     the action is consistent with AFMA objectives; and
(c)     no other action is appropriate.

1          Name of Order
This Order is the Fisheries Management (Southern and Eastern Scalefish and Shark Fishery Management Plan 2003) Temporary Order 2010.
 
2          Commencement
This Order commences on the date it is registered on the Federal Register of Legislative Instruments.
 
3          Particular words in subsection 56(3) of the Management Plan do not apply to Directions in certain circumstances
 
Where:
(a)    a Direction is given that fishing using gillnet methods as defined in the Southern and Eastern Scalefish and Shark Fishery Management Plan 2003 (the Management Plan) is not to be engaged in in the Commonwealth Gillnet Sector or Commonwealth Shark Hook Sector or the South Australian Coastal Waters Sector as defined in Schedule 1 Parts 1 and 2 respectively of the Plan; and
 
(b)   the stated purpose of the Direction is to put in place closures to protect Australian sea lions from the impact of fishing using gillnet methods;
 
then the words in subsection 56(3) of the Management Plan, ‘at least 7 days before the direction takes effect’ do not apply to the Direction.
 
Note:
The stated purpose of such a Direction is the purpose as stated in the Explanatory Statement to the Direction.
