Preliminary
1              Name of Direction
                This Direction is the Commonwealth Services Delivery Agency (Functions of Chief Executive Officer — Commonwealth Services and Enabling Services) Direction 2010.
2              Commencement
                This Direction commences on 1 March 2010.
3              Definitions
                In this Direction:
Act means the Commonwealth Services Delivery Agency Act 1997.
enabling services means services of the kind mentioned in Schedules 1 to 8.
Medicare Australia means the agency established by subsection 4 (1) of the Medicare Australia Act 1973.
Portfolio Department means the Department which administers the Act.
4              Direction to perform function — Commonwealth services
                Under paragraph 8 (1) (c) of the Act, the Chief Executive Officer is directed to perform the functions of:
                (a)    providing Commonwealth services; and
               (b)    without limiting paragraph (a), all of the following:
(i)      making the Chief Executive Officer or specified employees, or employees in specified classes of employees, who are staff of the Agency, available to exercise powers or perform functions in connection with the provision of Commonwealth services (including powers and functions delegated to the Chief Executive Officer or employees under any law, including a law of a State or Territory);
(ii)     determining a person’s eligibility for, or entitlement to receive or have access to, Commonwealth services;
(iii)    making payments in connection with the provision of Commonwealth services;
(iv)    maintaining records related to the provision of Commonwealth services;
(v)     disclosing to Commonwealth authorities and other persons information related to the provision of Commonwealth services (including personal information within the meaning of subsection 6 (1) of the Privacy Act 1988 about individuals to whom the Commonwealth services relate);
(vi)    undertaking education, compliance, investigation and enforcement activities related to the provision of Commonwealth services; and
                (c)    without limiting paragraph (a) or (b), providing Commonwealth services together with the Portfolio Department, Medicare Australia or another Commonwealth authority (as the case may be).
Note:  The terms Agency, Chief Executive Officer, Commonwealth authority and Commonwealth service are defined in the Act.
5              Direction to perform function — enabling services
                Under paragraph 8 (1) (c) of the Act, the Chief Executive Officer is directed to perform the functions of:
(a)          providing enabling services to Commonwealth authorities including the Portfolio Department and Medicare Australia; and
(b)         supervising the provision of enabling services by employees of the Agency, the Portfolio Department and Medicare Australia (as the case may be) to Commonwealth authorities including the Portfolio Department and Medicare Australia; and
(c)          without limiting paragraph (a) or (b), providing enabling services together with the Portfolio Department, Medicare Australia or another Commonwealth authority (as the case may be).

  (a)   administering programs to examine accounts and records;
  (b)   servicing and supporting audit committees of the Portfolio Department and Medicare Australia;
  (c)   reviewing performance and financial management;
  (d)   verifying statements or claims;
  (e)   providing recommendations for improvement;
   (f)   developing guidelines and quality assurance systems related to reporting.

  (a)   administering internal assurance programs and projects; and
  (b)   detecting and investigating employee misconduct and fraud.
 

 
Schedule 2        Communication and media services

Communication and media services administration and associated support services including, but not limited to, any of the following:
  (a)   managing and planning advertising and communications activities;
  (b)   developing strategies to disseminate government information including:
(i)      the promotion of government-wide or cross-jurisdictional initiatives to provide access to government services and information; and
(ii)          providing access to government information at government shopfronts, remote access points, retail outlets and kiosks; and
(iii)         designing and maintaining online services;
  (c)   providing publishing services including any of the following:
(i)          developing policies to support the compilation and distribution of government information by print or electronic media;
(ii)         managing material under government copyright;
(iii)       providing editing and publishing material in printed formats;
(iv)       compiling, editing and disseminating government information in electronic format;
(v)        developing, managing and maintaining website content and multi-media programs;
(vi)       managing print, production, design, warehousing and distribution services;
  (d)   supporting remote communities, through targeted information services and products to promote access to government services:
  (e)   managing compliance with copyright legislation including copyright registration;
   (f)   managing and implementing branding;
  (g)   managing broadcasting content services.

  (a)   recruitment and employee contracting;
  (b)   salary packaging;
  (c)   compensation for, and rehabilitation of, injured employees;
  (d)   occupational health and safety;
  (e)   processing of human resources related transactions (for example, payroll processing, leave entitlements and administration of employee superannuation);
   (f)   information technology support for human resources administration;
  (g)   human resources reporting;
  (h)   learning and development and training;
   (i)   workforce planning and determining workforce capability requirements;
   (j)   change management;
  (k)   employee and industrial relations including consultation, development and negotiation of employment contracts and collective agreements (however described);
   (l)   developing employment policies and procedures.

Information and communications technology services administration and associated support services including, but not limited to, any of the following:
  (a)   electronic commerce including the following:
(i)    administering programs to implement the use of information and communications technology for conducting business;
(ii)      managing infrastructure to support the validation and authentication of electronic transactions;
(iii)    supporting standards and monitoring compliance related to online transactions;
(iv)    providing electronic transactions such as bill payments and business lodgements;
(v)     providing and managing electronic mail processing activities;
  (b)   developing policies to support the organisation and use of government information including:
(i)      providing advice on the availability of new technology and the implications for government business; and
(ii)    encouraging the implementation of best practice information management strategies; and
(iii)    developing data security standards and policies;
  (c)   developing policies to support:
(i)      the exchange or transfer of information and data between government agencies or systems; and
(ii)    the cross-matching of data; and
(iii)   the use of metadata to support resource discovery or interoperability;
  (d)   developing strategies to disseminate government information including:
(i)      providing access to government information at government shopfronts, remote access points, retail outlets and kiosks; and
(ii)    designing and maintaining online ICT services;
  (e)   establishing guidelines and models to regulate the implementation of government hardware and software including:
(i)      promoting the application of information technology standards to support interoperability and data exchange; and
(ii)    providing advice on the implementation of standards and monitoring compliance;
   (f)   providing telecommunications services including:
(i)      advice on the introduction of new technology; and
(ii)    planning of facilities to support telecommunication services;
  (g)   providing services related to applications, infrastructure, service management, computing services and data centres.
 

Schedule 6        Information collection, access and release services

Managing and processing the collection, access and release of information including, but not limited to, any of the following:
  (a)   reviewing practices and systems in relation to the collection, access and release of information for compliance with Information Privacy Principles and Guidelines under the Privacy Act 1988;
  (b)   conducting privacy impact assessments of current and proposed practices and systems;
  (c)   carrying out audits of compliance by employees and contractors with the Privacy Act 1988 and with policies and procedures in relation to access to information;
  (d)   investigating possible breaches of Information Privacy Principles and Guidelines under the Privacy Act 1988;
  (e)   liaising with the Office of the Privacy Commissioner and other Government stakeholders on freedom of information and privacy issues;
   (f)   carrying out duties under the Freedom of Information Act 1982 and other legislation relevant to information collection, access and release;
  (g)   providing education and training in freedom of information, privacy and confidentiality issues;
  (h)   providing advice on the Freedom of Information Act 1982, Privacy Act 1988 and other legislation relevant to information collection, access and release;
   (i)   developing policies and procedures relevant to freedom of information, privacy and information collection, access and release.

  (a)   advising on the interpretation of legislation and other instruments;
  (b)   advocacy in Tribunals;
  (c)   support and conduct of Tribunal and Court proceedings;
  (d)   formulating and reviewing proposals for new legislation and for legislative amendments;
  (e)   advice on legal liability and risk management;
   (f)   settlement of claims and disputes;
  (g)   drafting of legal instruments and memoranda of understanding;
  (h)   monitoring compliance with legislation, policy and guidelines;
   (i)   instructing and managing external legal service providers;
   (j)   carrying out investigations and inquiries;
  (k)   liaising with law enforcement authorities in relation to possible breaches of the law relating to Commonwealth services or enabling services.

Services and support services to assist a Minister in participating in parliamentary matters and in performing ministerial duties including, but not limited to, the following:
  (a)   ministerial briefings;
  (b)   ministerial correspondence;
  (c)   question time briefings;
  (d)   briefings on, and preparation of responses to, parliamentary questions on notice:
  (e)   Senate estimates coordination (including preparation, attendance and coordination of responses to questioning);
   (f)   matters related to legislation liaison, Cabinet liaison and Executive Council liaison;
  (g)   management of Departmental Liaison Officers.
