Variation to the Licence Area Plan Canberra Radio – No.1 of 2009
1. Enabling legislation
The Australian Communications and Media Authority makes this instrument under subsection 26(2) of the Broadcasting Services Act 1992.
2. Name of Instrument
This instrument is the Variation to the Licence Area Plan for Canberra Radio – No. 1 of 2009.
3. Commencement
This instrument commences the day after it is registered.
Note: An instrument is registered when it is recorded on the Federal Register of Legislative Instruments (FRLI) in electronic form: see the Legislative Instruments Act 2003, s4 (definition of register). The FRLI may be accessed at http://www.frli.gov.au
4. Variation
The Licence Area Plan for Canberra Radio determined by the Australian Broadcasting Authority on 17 June 1999 and varied on 6 November 2003 and 27 April 2006 is varied as follows:
(a) omit clauses (1), (2), (3), (4,) (5), (6), (7), (8) and (9) of the determination and substitute the clauses having those same numbers in this instrument;
(b) omit Schedule One, Schedule Two, Schedule Three, Schedule Four and Schedule Five and substitute in the corresponding places the schedules to this instrument;
(c) omit all the attachments and substitute in numerical order the attachments to this instrument; and
(d) insert Attachment 1.33 of this instrument.

DETERMINATION
(1) The Australian Broadcasting Authority made this plan for broadcasting services in the Canberra area, under subsection 26(1) of the Broadcasting Services Act 1992.
(2) Eleven national radio broadcasting services are to be available in the area described at Attachment 1.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the national radio broadcasting services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.2 - 1.9, and 1.21 and 1.22 to this Determination.
(3) Four commercial radio broadcasting services are to be available in the area described at Attachment 1.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the commercial radio broadcasting services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.11 - 1.16 to this Determination.
(4) Four community radio broadcasting services are to be available in the area described at Attachment 1.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the community radio broadcasting services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.18, 1.19, 1.23, - 1.26, 1.31 and 1.33 to this Determination.
(5) Five open narrowcasting radio services are to be available in the area described at Attachment 1.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the open narrowcasting radio services that are to be available in the area described at Attachment 1.1 are set out in Schedule One and Attachments 1.27 - 1.30 and 1.32 to this Determination.
(6) One community radio broadcasting service is to be available in the area described at Attachment 2.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the community radio broadcasting service that is to be available in the area described at Attachment 2.1 are set out in Schedule Two and Attachments 2.2 and 2.3 to this Determination.
(7) One community radio broadcasting service is to be available in the area described at Attachment 3.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the community radio broadcasting service that is to be available in the area described at Attachment 3.1 are set out in Schedule Three and Attachment 3.2 to this Determination.
(8) One community radio broadcasting service is to be available in the area described at Attachment 4.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the community radio broadcasting service that is to be available in the area described at Attachment 4.1 are set out in Schedule Four and Attachment 4.2 to this Determination.
(9) One community radio broadcasting service is to be available in the area described at Attachment 5.1 to this Determination with the use of the broadcasting services bands. The characteristics, including technical specifications, of the community radio broadcasting service that is to be available in the area described at Attachment 5.1 are set out in Schedule Five and Attachments 5.2 and 5.3 to this Determination.

2. The day time coverage radius of a Medium Frequency service is defined by the estimated field strength contour of 54 dBuV/m, which is the protected field strength in the presence of man made radio noise alone in a rural radio noise environment. But this estimated coverage, to obtain the defined quality of service for that radio noise environment, could effectively reduce when considering the addition of natural noise.
