Amendments to Guidelines made under section 238-10 of the
Higher Education Support Act 2003
 
 
 
I, Chris Evans, Minister for Tertiary Education, Skills, Jobs and Workplace Relations pursuant to section 238-10 of the Higher Education Support Act 2003 (‘the Act’), make the attached Amendment No. 10 to the Commonwealth Grant Scheme Guidelines No.1, which provide for matters under Part 2-2 of the Act.

Amendment No. 10
 
 
 
(i)      CITATION
 
This legislative instrument may be cited as Amendment No. 10 to the Commonwealth Grant Scheme Guidelines No.1
 
(ii)   AUTHORITY
 
This legislative instrument is made under section 238-10 of the Higher Education Support Act 2003 (the Act) to give effect to matters set out in Part 2-2 and Section 93-10 of the of the Act.
 
(iii)  DATE OF EFFECT
 
This legislative instrument will come into effect on the day after registration on the Federal Register of Legislative Instruments.
 
(iv)  APPLICATION
 
This legislative instrument shall apply in relation to the year commencing 1 January 2012 or a later year.
 
(v)   AMENDMENT
 
This legislative instrument amends the Commonwealth Grant Scheme Guidelines No.1   which was registered on 12 December 2006 and which commenced on 13 December 2006 (see F2006L04079).
 
 
 
ITEM 1
 
Delete paragraph 3.5.1 and substitute:
 
3.5.1           The following outcomes are national priorities:
a)    increasing the number of persons undertaking teaching and nursing courses of study;
b)    supporting a number of persons undertaking Natural and Physical Sciences, Information Technology, Health, Education and Society and Culture courses of study at the University of Notre Dame Australia;
c)    supporting a number of Indigenous students undertaking courses of study at the University of Notre Dame Australia.
 
ITEM 2
 
Renumber existing paragraph 6.10.5 to 6.10.10.
 
 
ITEM 3
 
After paragraph 6.10.1 insert the following:
 
6.10.5         For the purposes of calculating enabling loading in 2012 and subsequent years, Commonwealth supported places at the Batchelor Institute of Indigenous Tertiary Education will be considered to be Commonwealth supported places at Charles Darwin University.
 
 
ITEM 4
 
After paragraph 11.3.3 insert the following
 
11.3.4         For the purposes of calculating transitional loading in 2012 and subsequent years, Commonwealth supported places at the Batchelor Institute of Indigenous Tertiary Education will be considered to be Commonwealth supported places at Charles Darwin University.  Any adjustments to the amount of transitional loading for 2011 or previous years will be a benefit or liability, as the case may be, to Batchelor Institute of Indigenous Tertiary Education.
