Amendments to Guidelines made under section 238-10 of the Higher Education Support Act 2003
 
 
 
I, Chris Evans, Minister for Tertiary Education, Skills, Jobs and Workplace Relations, pursuant to section 238-10 of the Higher Education Support Act 2003 (‘the Act’), make the attached Amendment No. 9 to the Commonwealth Grant Scheme Guidelines No.1, which provide for matters under Part 2-2 and section 93‑10 of the Act.

(i)                 CITATION
 
This legislative instrument may be cited as Amendment No. 9 to the Commonwealth Grant Scheme Guidelines No.1
 
 
(ii)                AUTHORITY
 
This legislative instrument is made under section 238-10 of the Higher Education Support Act 2003 (the Act) to give effect to matters set out in Part 2-2 and Section 93-10 of the Act
 
 
(iii)               COMMENCEMENT
 
This legislative instrument will come into effect on 1 January 2012.
 
 
(iv)              AMENDMENT
 
This legislative instrument amends the Commonwealth Grant Scheme Guidelines No.1   which was registered on 12 December 2006 and which commenced on 13 December 2006 (see F2006L04079). A compilation (see F2011C00839) was registered on 18 October 2011 taking into account amendments up to Amendment No. 8 to the Commonwealth Grant Scheme Guidelines No.1 (see F2011L01816).
 
 
 
ITEM 1
 
Delete paragraph 5.1.1 and substitute:
 
5.1.1  The purpose of this chapter is to specify how the amount of medical student loading for Commonwealth supported places under paragraph 33-1(1)(b)(ii) of the Act is to be worked out.
 
 
ITEM 2
 
Delete heading at 5.5 and substitute:
 
5.5                     MEDICAL STUDENT LOADING (section 33-1)
 
 
ITEM 3
 
Delete paragraph 5.5.5 and substitute:
 
5.5.5  Where the Minister allocates a number Commonwealth supported places for courses of study in medicine under section 30-10 of the Act, the amount of medical student loading that will be paid for Commonwealth supported places is worked out in the following way.

Delete paragraph 6.1.1 and substitute:
 
6.1.1. The purpose of this chapter is to specify how the amount of enabling loading payable to a provider under paragraph 33-1(1)(b)(iii) of the Act is calculated. 
 
 
ITEM 5
 
Delete paragraph 6.10.1 and substitute:
 
6.10.1         The amount of enabling loading (A) payable to a higher education provider for a year for Commonwealth supported places provided is calculated in the following way:
 
Step 1:  R = F divided by T
 
Step 2:  A = E times R
 
That is:                                             A = E times (F divided by T)
 
where:
 
F       is the total amount of the enabling loading funding pool for the grant year (see paragraph 6.15);
 
T       is the number of Commonwealth supported student EFTSL coded (in accordance with paragraph 6.20) as enabling student load for ALL HIGHER EDUCATION PROVIDERS in the most recent full year student load data reported by the providers through the Student Statistical Data Collection and cleared as final by the Department of Education, Employment and Workplace Relations; and
 
E       is the number of Commonwealth supported student EFTSL coded (in accordance with paragraph 6.20) as enabling student load at THE PARTICULAR HIGHER EDUCATION PROVIDER in the most recent full year student load data reported by the provider through the Student Statistical Data Collection and cleared as final by the Department of Education, Employment and Workplace Relations; and
 
R       is the amount of enabling loading per enabling Commonwealth supported student EFTSL in the given year.
 
The first step determines R, the amount of loading per enabling Commonwealth supported EFTSL.  The second step, using R calculated at step 1, determines A, the amount of enabling loading that the provider will receive.
 
 
ITEM 6
 
Delete paragraph 6.10.5 and substitute:
 
6.10.5         The number of EFTSL coded as enabling student load will be that reported in the most recent full year student load data submitted by the higher education provider as part of the student statistics data collection and cleared as final by DEEWR.
 
 
ITEM 7
 
Delete paragraph 11.1.1 and substitute:
 
11.1.1         The purpose of this chapter is to specify how the amount of transitional loading payable to a provider under paragraph 33-1(b)(iv) of the Act is worked out.
 
 
ITEM 8
 
Delete paragraph 11.2.2 and substitute:
 
11.2.2         The amount of transitional loading payable to a higher education provider for a year under paragraph 33-1(1)(b)(iiv) is worked out in accordance with section 11.3.
